關於認領，除親子關係之建立、稱姓或扶養問題外，尚須處理繼承之問題。若於生父生前已有任意認領或強制認領時，該非婚生子女已視為婚生子女，對於其後生父死亡時之遺產當有繼承權。然我國於民國96年5月23日修正民法第1067條第2項增設死後認領制度後，涉及與民法第1069條：「非婚生子女認領之效力，溯及於出生時。但第三人已得之權利，不因此而受影響。」之適用關係，亦即，於死後認領之情形，被認領子女是否因認領溯及效力而成為生父之繼承人？若認為該子女為生父之繼承人，其繼承權是否應受限制？其他共同繼承人之繼承權是否應受第1069條但書的保護？如果認為被認領子女對生父遺產不得主張權利，則其提起死後認領訴訟的意義何在？是否與我國死後認領制度之立法精神有違，而被批判為婚生子女與非婚生子女之差別對待？又如認為被認領子女之繼承權應受到保障，則第1069條但書規定如何解釋？我國現行實務如何調和被認領子女與其他共同繼承人之繼承權？其作法之理由及正當性何在？比較法上是否有值得供我國法借鏡之處？上開問題皆源自我國立法者增訂死後認領制度，卻未處理其與第1069條但書之適用關係，導致死後認領子女取得繼承權之解釋困難。是本文擬先就強制認領之修正與死後認領之增訂作簡要之立法說明，再論述被認領子女與生父之其他繼承人的繼承權之衝突與調和。
