Os gregos antigos não só tiveram um direito evoluído, como influenciaram o direito romano e alguns de nossos modernos conceitos e práticas jurídicas: o júri popular, a figura do advogado na forma embrionária do logógrafo, a diferenciação de homicídio voluntário, involuntário e legítima defesa, a mediação e a arbitragem, a gradação das penas de acordo com a gravidade dos delitos e, finalmente, a retórica e eloqüência forense. Essa influência não foi resultado de um acaso, mas fruto da atividade, do envolvimento e da genialidade de um povo que, além de se haver destacado na filosofia, nas artes e na literatura, destacou-se também no direito. Na história de uma civilização, a diferença muitas vezes reside naquilo que as gerações seguintes, atuando como filtro, preservaram e transmitiram, ou deixaram de fazê-lo.68 Em sua tragédia Édipo em Colono, Sófocles sintetizou a visão do ateniense sobre o direito quando Teseu, rei de Atenas, profere suas famosas palavras a Creonte, rei de Tebas: "Entra num território submisso à justiça, e decide cada coisa de acordo com a lei.”69
