דברי חכמים ופשט התורה במצוות הקידושין
ע"פ הרמב"ם, הכלים בהם משתמשים חכמים כדי ללמוד את התורה אינם קוד שניתן לחכמים כדי להבין את הצפון במה שכתוב בתורה, אלא השתלשלות לוגית של דברי התורה למימושם במציאות. הדבר בא לידי ביטוי במצוות הקידושין: מדאורייתא רק ביאה היא דרך הקיום שלה, וחכמים ע"פ הבנתם את מגמת התורה תיקנו שגם כסף (ולמעשה גם שטר) יכול לקיים את הקידושין. זו משמעות הגזירה השווה שמופיעה בתחילת מסכת קידושין "קיחה קיחה משדה עפרון" – מושג הקניין שהושאל כדי לקיים את הקידושין מביא איתו את הכסף, אך אין זה קניין רכושני אלא הענקת מעמד משפטי לקידושין, במקום המעמד היצרי שהיה קודם מתן תורה.

עניינה של מצוות הקידושין
מצוות הקידושין היא מיסוּד הרצון הטבעי לעניין משפטי, דבר המשנה את אופי העניין כולו: ההבדל בין המצב קודם מתן תורה למצב שלאחר מתן תורה מבחינת הקידושין, הוא שקודם מתן תורה הרצון היה רומנטי בלבד, ואילו לאחריה הוא נעשה הלכתי משפטי. הביאה הופכת מעניין טבעי לעניין משפטי, המבחין בין האדם לבעלי החיים, משום שהרצון בנישואין נצרך כדי לייסד חברה בריאה, ויש לעצב אותו במסגרת מסוימת עבור כך.

משמעות ההלכה שמצוות צריכות כוונה
