DEFENCE OF BONA FIDE CLAIM OF RIGHT, SCOPE AND INGREDIENTS OF THE DEFENCE (CRIMINAL LAW)

<p><i>Ignorance of the law is not an excuse but such ignorance can be an important factor in negating mens rea</i></p><p><br></p><p>The <b>Defence of Bona Fide Claim of Right</b> or the Defence of Claim of Right is provided in <b>Section 23</b> of the criminal code. Unfortunately, there is no provision for this claim in the Penal Code. Prof <b>Okorie Chimezie</b> aptly noted that Bona fide Claim of Right is a defence made by the defendant to show that he was acting in respect to any property in the exercise of an honest claim of right and without intention to defraud. This defence is made only in information relating to properties. This is because property as rightly observed by, <b>Chukkol</b>, is the second most important possession of man next to life. </p><p><br></p><p>The key ingredients of this definition is "<b>honest claim of right</b>" and "<b>without intention to defraud</b>". Without this two essential ingredients, any claim brought under the Bonafide Claim of Right will die a natural death. The defendant must show that his actions was done in good faith with all honesty, integrity, truthfulness and straightforwardness. The defendant is also expected to show that the alleged offence committed was sincere and devoid of lying and cheating. </p><p>For example, X accidentally leaves his phone on a classroom desk. Y enters the room shortly after, sees the phone, and believing it to be his own (as it is identical in make and model), picks it up and leaves. Later, upon realizing the mistake, Y returns the phone. If X sues Y for theft, Y may raise a bona fide claim of right as a defense, asserting that he genuinely believed the phone was his and had no intention to permanently deprive X of it.</p><p><br></p><p>It is also pertinent to note that the reasonableness of honesty in this defence is immaterial and the test subjective. See the case of <i>Dabierin v State.</i></p><p><br></p><p>We also argued on why an unlawful and uncivilised conduct of the defendant in pursuit of honest claim of right should/should not bar the operation of the defence. After all, the law is made to maintain peace and order in the society and not turn it to a den of confusion. THE NEW NIGERIA TAX ACT, 2025, THE PURPOSE, IMPLICATION AND CONSEQUENCE

<p>Today we shall unravel the wool beclouding the implementation of the <b>Nigeria Tax Act 2025</b>. We have identified who is eligible to pay taxes and who is ineligible to do same. The Nigeria Tax Act was not brought about to worsen and overburden the average Nigerians who are struggling to provide their daily bread rather it was brought to ameliorate the complexities of the previous tax laws and consolidate them into one single unified statute in the interest of Nigerians. The government is only taking little from you and I to advance our nation. </p><p><br></p><p>A common misconception is that every Nigerian citizen or any individual doing business in Nigeria one way or the other will be taxed. It is pertinent to note that individuals earning below <b>₦800,000.00</b> are automatically exempted from <b>Personal Income Tax</b>. So if you're salary earner, freelancer, content creator, student etc and your annual revenue is ₦800,000.00 or less, you're automatically free from paying any tax. On the other hand, companies generating <b>₦25 million</b> naira or less are also exempted from paying <b>Company Income Tax</b>. </p><p><br></p><p>It is highly important that we understand that tax is a globally recognised method in which the government collects a percentage from your income to develop the country. Emphasis on "<b>income</b>" because the government is not taxing your revenue in entirety but rather it taxing your <b>profit</b>.
