US-ISRAELI STRIKES ON IRAN: LEGAL DILEMMA, SOVEREIGNTY AND CONSEQUENCES
Today, we will examine the legal dilemma facing the United States of America and Israel as a result of their joint strike on Iran. We will also explore the consequences of this action on the Iranian government and its citizens. According to reports, the United States, in collaboration with Israel, carried out an operation on February 28, 2026, that resulted in the death of Iran’s Supreme Leader, Ali Khamenei. The strike was allegedly motivated by concerns over nuclear weapon development and accusations of dictatorial governance over the Iranian people. DEFENCE OF BONA FIDE CLAIM OF RIGHT, SCOPE AND INGREDIENTS OF THE DEFENCE (CRIMINAL LAW)
Ignorance of the law is not an excuse but such ignorance can be an important factor in negating mens rea The Defence of Bona Fide Claim of Right or the Defence of Claim of Right is provided in Section 23 of the criminal code. Unfortunately, there is no provision for this claim in the Penal Code. Prof Okorie Chimezie aptly noted that Bona fide Claim of Right is a defence made by the defendant to show that he was acting in respect to any property in the exercise of an honest claim of right and without intention to defraud. This defence is made only in information relating to properties. This is because property as rightly observed by, Chukkol, is the second most important possession of man next to life. The key ingredients of this definition is "honest claim of right" and "without intention to defraud". Without this two essential ingredients, any claim brought under the Bonafide Claim of Right will die a natural death. The defendant must show that his actions was done in good faith with all honesty, integrity, truthfulness and straightforwardness. The defendant is also expected to show that the alleged offence committed was sincere and devoid of lying and cheating. For example, X accidentally leaves his phone on a classroom desk. Y enters the room shortly after, sees the phone, and believing it to be his own (as it is identical in make and model), picks it up and leaves. Later, upon realizing the mistake, Y returns the phone. If X sues Y for theft, Y may raise a bona fide claim of right as a defense, asserting that he genuinely believed the phone was his and had no intention to permanently deprive X of it. It is also pertinent to note that the reasonableness of honesty in this defence is immaterial and the test subjective. See the case of Dabierin v State. We also argued on why an unlawful and uncivilised conduct of the defendant in pursuit of honest claim of right should/should not bar the operation of the defence. After all, the law is made to maintain peace and order in the society and not turn it to a den of confusion. Should the defendants be encouraged to take laws into their own hands in the pursuit of a claim? PLEASE NOTE: THE PURPOSE OF THIS PODCAST IS FOR EDUCATIONAL PURPOSES ONLY. THE NEW NIGERIA TAX ACT, 2025, THE PURPOSE, IMPLICATION AND CONSEQUENCE
Today we shall unravel the wool beclouding the implementation of the Nigeria Tax Act 2025. We have identified who is eligible to pay taxes and who is ineligible to do same. The Nigeria Tax Act was not brought about to worsen and overburden the average Nigerians who are struggling to provide their daily bread rather it was brought to ameliorate the complexities of the previous tax laws and consolidate them into one single unified statute in the interest of Nigerians. The government is only taking little from you and I to advance our nation. A common misconception is that every Nigerian citizen or any individual doing business in Nigeria one way or the other will be taxed. It is pertinent to note that individuals earning below ₦800,000.00 are automatically exempted from Personal Income Tax. So if you're salary earner, freelancer, content creator, student etc and your annual revenue is ₦800,000.00 or less, you're automatically free from paying any tax. On the other hand, companies generating ₦25 million naira or less are also exempted from paying Company Income Tax. It is highly important that we understand that tax is a globally recognised method in which the government collects a percentage from your income to develop the country. Emphasis on "income" because the government is not taxing your revenue in entirety but rather it taxing your profit. This way it can ensure that the capital used in running your business is not taxed. PLEASE NOTE: THE PURPOSE OF THIS PODCAST IS FOR EDUCATIONAL PURPOSES ONLY. INTRODUCTION TO CONTRACT, MEANING & CLASSIFICATION OF CONTRACT, WHY IS A CONTRACT BINDING
Every contract is an agreement but not every agreement is a contract Most of us are oblivious of the fact that we enter into contracts in the course of our day to day activities. We enter into contracts almost everyday. We enter into contracts when we use public transports. When you go to market to buy pepper from the pepper seller, you've entered into a binding contract that will be legally recognised by the court if there's a breach. When a man promises to marry a woman, it becomes is a binding contract! If he defaults and gets married another woman, that's a breach of contract and the promisee can sue him to claim damages. Even a gratuitous promise made to a friend can become a binding contract with or without the furnishing of consideration by the promisee. One key thing to note in contract is that it is an agreement that is legally binding and enforceable by law . Whenever an issue arises in a contract, the court looks at the terms of that contract to determine who wronged who or if at all, there was any wrong in the first place. In every contract there is an offeror ( the one who initiates and proposes the offer) and the offeree (the one who accepts the offer). For a contract to be binding, there must be mutuality of purpose and intention. We have stated that "every contract is an agreement but not every agreement is a contract" but the big question here is: How do I know if the agreement I entered into with someone is a contract? There are five (5) essential elements that must be present for an agreement to qualify as a valid contract... Listen to the full episode in our podcast to know these essential elements PLEASE NOTE: THE PURPOSE OF THIS PODCAST IS FOR EDUCATIONAL PURPOSES ONLY. DO NOT TAKE ANY OF OUR EPISODES FOR LEGAL ADVICE. LEGAL WRITING, DIVISIONS AND TYPES OF LEGAL WRITING (NIGERIAN LEGAL METHOD)
Bankers have a method of writing. Doctors have a method of writing. So also do lawyers have their stylistic approach when it comes to writing. This is what we refer to as Legal Writing. Legal writing is the method by which authors communicate and convey their messages to readers on a particular legal issue or concept. The major aim of legal writing is not to confuse the readers or impress them with high vocabulary, but to satisfy the minds of the readers. Legal writing must be devoid of ambiguity and vagueness. It must be clear, concise, and only contain relevant facts. It must not be verbose or unduly repetitive (see the case of Theophilus Onuoha v. The State). A good legal writing skill not only makes your work organised, but also makes you stand out. In this episode, we discussed how important legal writing is for legal authors and how one can achieve good legal writing skills. We highlighted the broad divisions of legal writing, ways to improve legal writing skills, types of legal writing, as well as essay writing. Legal writing is a fundamental, must-have skill for everyone interested in drafting legal documents. It is, therefore, very important that we, as law students, master the art and science of good legal writing. PLEASE NOTE: THE PURPOSE OF THIS PODCAST IS FOR EDUCATIONAL PURPOSES ONLY. VDM V BLORD CONTROVERSY, THE LEGAL IMPLICATIONS AS WELL AS LEGAL OPINION ON THE CASE
In today's episode David Njoku discussed on a trending controversial dispute between Vincent Martins (VeryDarkMan) and Linus Martins (Blord). We discussed the legal implications of their actions and whether or not there are liable on any statute in Nigeria. We highlighted that BLord's action did not amount to misrepresentation or fraud as pursuant to Section 419 of the Criminal Code. Reason being that he disclosed publicly that the product in question was a rebranded iPhone XR in iPhone 17 body. This showed transparency on BLord's side. However, we also identified how the release of that obscene material on his Instagram story contravened Section 24(1)(a),(b) of the Cyber Crimes Act making his liable to fine of 7 million naira or imprisonment of up to 3 years or both fine and imprisonment.
