(一)國營航空站噪音補償金分配及使用辦法之法令依據為民用航空法第37條第5項規定。 其規定承我國民用航空法第三十七條第一、三項規定，如下： 第37條第1 項:「使用航空站、飛行場、助航設備及相關設施，應依規定繳納使用費、服務費或噪音補償金…」。 第3項規定:「第一項噪音補償金，得以現金發放之方式辦理航空站附近地區噪音補償作業。」 至於有關噪音補償金之經費分配及使用辦法，則依照民用航空法第37條第5項規定內容:「第3項之經費分配及使用規劃，國營航空站由交通部定之。非屬國營之航空站之經費分配及使用計畫，由經營人擬訂，報請民航局核轉交通部核定。」 (二)噪音防制設施之項目包含： 1.防音門窗。 2.開口部消音箱。 3.其他必要之航空噪音防制設施如吸音天花板、吸音壁面、空調設備及配合防制作業之房舍整修。 4.公園：都市計畫、區域計畫內公園，具有吸收航空噪音或隔離航空噪音源效果之設施。 5.緩衝綠帶：道路綠化、帶狀植被，其綠覆率須達百分之八十以上，其中多年生喬木須達百分之四十以上。 6.其他有助隔離或降低航空噪音影響之公共設施。
