O nesgo de xénero nos delitos sexuais
<p>Neste podcast falo do nesgo de xénero que existe en relación aos delitos sexuais. O noso Código penal distingue entre agresión e abuso sexual, considerando unha modalidade de abuso o feito drogar a unha persoa para violala. Para poñer de manifesto a incoherencia legal utilizo como referencia a aleivosía, que consiste en cometer un delito de xeito que o autor se asegure da súa comisión mediante a eliminación das posibilidades defensivas da vítima. Así, mentras que a aleivosía é unha circunstancia que agrava a pena, drogar a unha persona para cometer un delito sexual é unha circunstancia que atenúa o delito. Non é coherente que un mesmo comportamento sirva para agravar e para atenuar a pena. Como argumento, isto non é máis que consecuencia do androcentrismo legal. </p>
