Yang menjadi tolak ukur dalam masalah makan dan minum saat salat adalah kesengajaan. Jika sengaja menelan sisa makanan meskipun sedikit, maka salatnya batal. Hal ini sebagaimana dikatakan Imam Nawawi dalam kitab AlMajmu berikut. وإن كان بين أسنانه شئ فابتلعه عمدا أو نزلت من رأسه فابتلعها عمدا بطلت صلاته بلا خلاف “Dan jika ada sesuatu di sela-sela giginya kemudian menelannya dengan sengaja atau turun dari kepalanya kemudian menelannya dengan sengaja maka salatnya batal tanpa ada perselisihan.”
