대법원 간 "트럼프 관세"
<p>지난 두 편에 걸쳐 글로 쓴 이야기를 팟캐스트로도 풀어봤습니다. 트럼프 행정부가 포괄적인 상호 관세를 부과한 근거로 삼은 국제경제비상권한법(IEEPA)에 대한 해석과 헌법이 의회에 위임한 권한을 대통령이 이렇게 마음대로 가져다 쓰는 게 정당한지 등 트럼프표 관세를 둘러싸고 구두변론에서 어떤 이야기가 오갔는지 자세히 짚어봤습니다.</p> <p>미국에서 대법원판결은 그 자체로 헌법에 준하는 효력을 갖습니다. 우리나라 사법 체계에는 미국 대법원에 해당하는 권한을 지닌 기관이 없으므로, 대법원을 과소평가하기 쉽습니다. 예를 들어 '제아무리 대법원이라고 해봤자, 대통령이 마음먹으면 뭐든 할 수 있는 거 아니야? 게다가 여당 의원들도 대통령 말 한마디에 꼼짝 못 하는데?'라고 생각할 수 있지만, 그건 미국 대법원의 위상을 잘 모르고 하는 말입니다.</p> <p>물론 이번 사건에서 대법원이 청구인의 주장을 받아들여 트럼프표 상호 관세를 좌초시키면, 트럼프 대통령은 또 어떻게든 기존에 발표했던 것과 최대한 비슷한 관세를 만들어내려고 방법을 찾을 겁니다. 그렇더라도 전례 없는 속도, 범위, 강도로 '제왕적 대통령'을 향해 달려가던 트럼프에게 처음으로 미국 헌법이 제동을 걸게 되는 것만으로도 어떤 판결이 나오든 이번 사건은 트럼프 2기 행정부의 운명은 말할 것도 없고, 미국 민주주의의 진로를 정하는 데도 결정적인 역할을 하게 될 겁니다.</p> <p>마지막에 '관세가 좌초되면 우리는 어떻게 해야 할까?'에 관해 이야기를 나눴는데요, 특히 우리 정부는 '모든 걸 원점에서 다시 검토하고 협상할 수 있다'는 자세로 진짜 국익에 부합하는 결과를 얻어내기 위해 철저히 대책을 세워둬야 합니다.</p> <p>대법원판결이 나오면 다시 관련 소식을 전하겠습니다. 그때까지는 뉴스레터 두 편과 이 팟캐스트 에피소드가 사안을 이해하는 데 도움이 되면 좋겠습니다. 질문과 코멘트 늘 기다리고 있습니다. americaknow2020@gmail.com으로 많이 보내주세요!</p>

'미니 중간선거' 분석
<p>지난 4일 치러진 '미니 중간선거'에서 민주당은 뉴욕 시장, 뉴저지 주지사, 버지니아 주지사, 그리고 캘리포니아에서 게리맨더링을 허용하는 주민투표까지 모두 승리했습니다. 물론 가장 많은 이목을 끈 뉴욕 시장 선거에서 주류 민주당은 위협을 느낄 수도 있는 민주적 사회주의자 조란 맘다니가 당선되긴 했지만, 그래도 전체적으로 트럼프 대통령과 여당 공화당에 대한 심판 정서가 도드라진 선거였다고 할 수 있습니다.</p> <p>아메리카노의 정치통 유혜영 교수의 한줄평은 "민주당은 이번 승리에 너무 도취되지 말 것, 공화당은 애써 별 일 아니라고 일축하지 말 것"이었습니다. 저는 한줄평은 없지만, <a href= "https://americaknow.substack.com/p/22-d98">프린스턴에서 온 편지</a>에 썼던 이야기를 다시 한번 풀어봤습니다.</p> <div class="pencraft pc-display-flex pc-gap-16 pc-reset"> <div class="pencraft pc-reset"><a href= "https://americaknow.substack.com/p/22-d98" target="_blank" rel= "noopener"><picture><source srcset= "https://substackcdn.com/image/youtube/w_728,c_limit/l07-V2rCebw" type="image/webp" /></picture></a></div> </div> <p> </p>
