[…] But also, during that process, what the statute says is that the agency... is supposed to determine whether or not any take will occur. And if take will occur, then various kinds of measures have to be adopted by one of these expert agencies, the Fish and Wildlife Service or the National Fish and Wildlife Service and what's called the Action Agency, the agency taking the action, the Forest Service, one of the agencies that regulates actions in the ocean, etc., they have to basically consult in order to determine whether or not take will occur and to minimize and mitigate that take. Now, for purely private actions, there's a separate process called the incidental take permit process, in which what the statute says, if you want to have an adverse impact on a species, including through habitat, loss or degradation.
