In this episode, we introduce the final three concepts in our study of negligence: remedies, psychiatric harm and economic loss.
We will consider academic commentary from a range of texts to understand how specific cases have set precedents for the ways courts in England and Wales award remedies in negligence claims, as well as case law that provides precedents in claims for pscyhiatric injury and pure economic loss.

We will make use of case law and legislation as well as academic commentary from undergraduate, postgraduate and practitioner level textbooks to consider some of the rules and principles which govern the defences of consent, contributory negligence and illegality.

In this episode, we introduce the next three concepts which relate to the tort of negligence: causation, remoteness and loss).
We will consider the different tests applied by courts when determining factual and legal causation, as well as the effect of new intervening acts on the causal chain. Case law and textbook commentary will introduce us to some general principles, as well as some exceptional approaches taken by courts in particular cases, which we will later apply to fact-based problems encountered by clients affected by negligence.

Negligence I
In this episode, we introduce the first elements of the tort of negligence: duty of care and breach of duty of care.
We will consider special relationships between claimants and defendants which give rise to special standards of care. We will also explore some of the ways in which breach of duty is proved and some of the factors which courts take into account when determining breach of duty.
