022: When Licensing Crosses the Line - What Can You Do?
When Licensing Crosses the Line: What Can You Do? The Assisted Living Compliance Podcast What happens when you feel like your licensor is targeting you? What if the very department responsible for ensuring compliance is making it more difficult for you to achieve it? In this episode of The Assisted Living Compliance Podcast, I share firsthand experiences involving licensing practices that raised serious concerns about fairness, discrimination, and accountability. So, what can you do when you believe licensing is treating you unfairly? 1. Know the Department’s Policies, Procedures, and Timelines Licensing departments have their own internal procedures, administrative requirements, and timelines. Understanding these processes can help you recognize when something isn’t being handled appropriately and determine what steps you can take to address it. 2. Communicate Through Email When dealing with licensing concerns, written communication is important. Emails create timestamps, establish a record of communication, and help document what was requested, discussed, or promised. 3. Know When to Escalate Your Concerns If you’re not receiving appropriate responses or believe your concerns aren’t being addressed, consider involving a licensing supervisor or contacting your state representative. When appropriate, copying relevant officials on correspondence may help bring additional attention and accountability to unresolved matters. 4. Consider Hiring an Attorney Sometimes regulatory disagreements require legal assistance. An attorney familiar with administrative law or healthcare regulations may help you understand your rights, challenge enforcement actions, and navigate formal appeals. 5. Work With a Compliance Consultant An experienced compliance consultant can help you evaluate regulatory findings, understand applicable requirements, organize documentation, and develop a strategy for addressing compliance concerns. 6. Learn From Experienced Regulatory Professionals Building a better understanding of how licensing works can be valuable. Consider seeking educational opportunities, professional training, or consulting services from former licensing professionals. Be mindful of conflict-of-interest rules and professional boundaries when approaching current government employees, particularly those involved in regulating your facility. Licensing departments should be held accountable to the same principles of professionalism, fairness, and procedural integrity that they expect from facility operators. But there’s an important distinction between a licensor who is doing their job thoroughly and one who may be acting inappropriately. The goal isn’t to avoid accountability or challenge every violation. It’s to understand your rights, know the regulatory process, and take appropriate action when you believe something isn’t right. Remember: Compliance is your responsibility, but fair and consistent regulatory enforcement matters too. Looking for resources to help improve your facility’s compliance systems? 021: Want to Give a Resident a 30-Day Notice? Document This First
Want to Give a Resident a 30-Day Notice? Document This First. The Assisted Living Compliance Podcast | Hosted by Lonnie Ridgeway What happens when an assisted living resident becomes destructive, aggressive, or disruptive, and facility management begins considering a 30-day discharge notice? Before issuing that notice, there's one important question every facility operator should ask: What does your documentation actually demonstrate? In this episode of The Assisted Living Compliance Podcast, Lonnie Ridgeway, former government assisted living facility licensor and investigator, current facility owner, and compliance consultant, discusses the importance of accurate documentation when managing residents who exhibit destructive or aggressive behaviors. Simply documenting that a resident is "aggressive," "difficult," or "destructive" may not be enough to support a discharge decision. Facility operators must be able to demonstrate what happened, how staff responded, what interventions were attempted, and whether the facility took appropriate steps to address the resident's needs. From the perspective of a former government licensor, Lonnie explains why documentation should tell the complete story—not just highlight the resident's behavior. Documenting behaviors objectively: Why factual descriptions of incidents are more valuable than subjective statements or opinions. Documenting staff interventions: How to demonstrate what your facility did to address destructive or aggressive behaviors. Establishing patterns of behavior: Why consistent incident reporting and progress notes are essential when documenting recurring concerns. Protecting other residents and staff: How to document safety risks, property damage, and the impact of destructive behavior on facility operations. Preparing for a potential discharge: What operators should review before considering a 30-day notice, including assessments, service plans, interventions, and applicable regulations. Understanding the licensor's perspective: Why an investigator may examine the facility's response just as closely as the resident's behavior. Your documentation should demonstrate not only what the resident did, but also what your facility did in response. A facility may have numerous incident reports describing destructive behaviors, but those reports alone may not establish that a discharge is justified. Accurate documentation, appropriate interventions, resident reassessments, and compliance with applicable discharge requirements are essential to making informed and defensible decisions. Remember, issuing a 30-day notice does not automatically make a resident discharge compliant. Discharge requirements, notice periods, and resident protections vary by state and facility type. 020: Why Does Licensing Keep Finding Something Wrong?
Why Does Licensing Keep Finding Something Wrong? The Assisted Living Compliance Podcast Have you ever asked yourself, “Why does licensing always find something wrong with my facility?” Does it feel like every time a licensor or auditor walks through your doors, they find another compliance issue? In this episode of The Assisted Living Compliance Podcast, Lonnie Ridgeway, former government assisted living facility licensor and investigator, current facility owner, and compliance consultant, explains why some facilities seem to attract more scrutiny than others. Are You a Frequent Flyer? Some assisted living facilities repeatedly find themselves out of compliance. But is licensing being overly critical, or are there underlying operational problems that continue to go unaddressed? Lonnie discusses why repeat compliance findings may be a sign of deeper issues within a facility's operational systems. Surface-Level Symptoms Can Lead to Deeper Investigations Licensors and auditors are trained to look beyond what they initially observe. Something as simple as poor cleanliness, disorganization, or an obvious safety hazard can raise questions that lead to a much deeper review. Think about pulling a few strands of hair out of a bathtub drain, only to discover a massive clump of hair underneath. Compliance inspections can work the same way. A seemingly minor issue catches the attention of a licensor. They begin asking questions, reviewing documentation, interviewing employees, and examining whether that initial observation points to a larger problem. Suddenly, what appeared to be a small issue has turned into multiple compliance findings. In This Episode, You'll Learn: Why some assisted living facilities repeatedly receive compliance findings. How surface-level symptoms can attract additional regulatory scrutiny. Why licensors and auditors ask questions that go beyond their initial observations. How cleanliness, organization, and safety hazards can influence the direction of an inspection. Why correcting visible problems before an inspection can help reduce unnecessary scrutiny. The importance of addressing underlying operational weaknesses instead of repeatedly fixing individual deficiencies. The Bottom Line Not every compliance finding begins with a major violation. Sometimes, it's the small, visible problems that give an auditor a reason to start asking deeper questions. While eliminating surface-level symptoms won't guarantee a deficiency-free inspection, maintaining an organized, clean, and safe facility can help demonstrate that your operations are under control. The goal shouldn't be to hide problems from licensing. It should be to build operational systems that prevent those problems from developing in the first place.
