The Case That Took Down Big Tobacco: Lessons from the Attorney General Who Filed It
The Case That Took Down Big Tobacco: Lessons from the Attorney General Who Filed It
For forty years, every smoker who sued Big Tobacco lost. Juries always sided with the industry: you chose to smoke. Then in May 1994, a 41-year-old attorney general from Mississippi walked into a county courthouse with two other lawyers and a theory nobody had tried. Across the aisle sat sixty-eight tobacco lawyers. Four years later, the industry signed the largest civil settlement in American history, killed Joe Camel and the Marlboro Man, and paid the states $246 billion.
Moore joins host Abdi Lopez to tell the story from the inside: the three-lawyer team that showed up to face sixty-eight tobacco lawyers at the first hearing, the governor who sued his own attorney general to stop the case, the whistleblower documents smuggled out in a girdle, the Jeffrey Wigand deposition dramatized in The Insider, and the negotiations with tobacco CEOs that led to the Master Settlement Agreement.
Along the way, the conversation covers why forty years of individual smoker lawsuits failed and how changing the plaintiff from the smoker to the state beat the "you chose to smoke" defense; the novel claims of fraud, unjust enrichment, and restitution that replaced a traditional subrogation suit; the epidemiological evidence that let the state prove Medicaid costs statistically; and the attorney general's enforcement toolkit, including civil investigative demands, suing without class certification, and civil penalties, along with the criticisms that come with that power.
Visiting contributor David Seligman, Executive Director of Towards Justice, stops by to add the private-enforcement perspective on class actions, forced arbitration, and why he believes now is not the time for law students to be cautious.
Mike Moore served as Mississippi's attorney general from 1988 to 2004 and has since been a lead negotiator in the BP Deepwater Horizon and national opioid settlements. He practices at the Mike Moore Law Firm in Flowood, Mississippi.
