辺野古事件を考える | Ep129-2

国旗を燃やしたら犯罪？―国旗損壊罪と表現の自由の境界線 | 128-1
<p>自民党と維新が通常国会への提出を目指す「国旗損壊罪法案」。日の丸を燃やしたり破ったりした場合だけでなく、その映像を公開した場合も処罰対象となる可能性があります。</p><p><br></p><p>そもそも誰が被害者なのか？国民感情なのか、国家なのか。それとも外交上の問題なのか。</p><p><br></p><p>現在の日本には、外国の国旗を侮辱する「外国国章損壊罪」は存在する一方、日本国旗を損壊する行為を直接処罰する法律はありません。この“法の非対称性”を是正するための法案だとされていますが、一方で表現の自由や罪刑法定主義との関係を懸念する声もあります。</p><p><br></p><p>アメリカでは国旗焼却が憲法上の表現の自由として保護される一方、中国や韓国、ドイツ、フランスでは処罰規定が存在します。各国はどのようにバランスを取っているのでしょうか。</p><p><br></p><p>今回は、国旗とは何なのか、国家の尊厳とは何なのか、そして自由社会において何を処罰すべきなのかについて、元国会議員・椎名毅と北澤直が議論します。</p>
