Trump Isn’t Banning Reporters Because They’re Unfair. He’s Banning Them Because You Vote in a Few Weeks.

You already know what gas costs. You watch that number tick up on the drive to work every morning. Right now, it’s somewhere around $4.48 a gallon, give or take. That’s roughly a dollar and a half more than you were paying before February. If you farm or haul or drive an 18-wheeler, you know what diesel costs, and it’s worse. Nobody needs CNN or other news organizations to tell them what’s observable. You can read a sign. What you might need a reporter for is the next part: why. In late February this country went to war with Iran. President Trump said it would be over quickly. It is now month seven. The Strait of Hormuz, a channel in the Middle East through which a fifth of the world’s oil moves, has been contested since spring. When the Bureau of Labor Statistics reported that gasoline jumped again in August, economists, market analysts and financial news outlets widely agreed that the war in the Middle East is the primary reason behind the price hike. At least eighteen American service members are dead across the wider regional conflict, six of them in a drone strike on a base in Kuwait. The Pentagon has extended deployments into 2027 after telling families it wouldn’t. Ammunition stockpiles are thin enough that senior commanders have raised it with the Defense Secretary. That is the reporting being done at CNN, MS NOW and Politico. It isn’t commentary, and it certainly isn’t somebody’s opinion about the president’s temperament. That is what the White House press corps has been filing for six months. It’s that reporting the president continues to attack. In March, when CNN reported that his national security team had not planned for Iran closing Hormuz, his press secretary declared the story fake news. This month, when outlets reported the ammunition shortages, he called the coverage treasonous. When the Defense Secretary was asked about coverage of dead American troops, he suggested it existed to make the president look bad. Then on Friday the president announced that CNN, MS NOW and Politico were banned from the White House. Saturday morning their reporters were turned away at the gate and their passes taken. On Monday, they sued. Here is the part worth sitting with. In his social media post announcing the ban, and in everything he has said since, the president has not identified a single story that was wrong. Not one article, not one error, not one correction demanded. When he was asked directly whether he was trying to intimidate the press, he said the outlets write negative news to “diminish the Republicans.” That is not a complaint about accuracy. That is a statement about an election. And that’s what makes this different from the usual fight between a president and reporters who annoy him. Every president has hated his coverage. So, Trump claiming negative coverage is fake is not new. What is new is that he now readily admits coverage about the Middle East and consumer prices hurts Republicans six weeks before an election. And that’s the point of banning reporters from the White House. So, ask yourself the practical question, the one that actually touches your life. What is it he doesn’t want you to see or hear before November? It’s not the high prices, because Trump can’t hide that truth. It’s on a sign at eye level in every town in America, and he knows it. What Trump can do is interrupt the explanation. You are going to feel this war either way. The only question is whether you know that’s what you’re feeling, or whether you spend the next six weeks being told it’s somebody else’s fault: Ukraine, the Federal Reserve, Joe Biden, the oil companies, whoever’s available. Trump is not protecting you from lies. He is betting that you can feel the pain of higher bills and not connect it to his choices. That is a bet about you. Honestly, I’d take it personally if I were you. Thanks for reading BEYOND THE TALKING POINTS! Subscribe for free to receive new posts and support my work. And notice you don’t have to take a single news network’s word for any of it. Republican Sen. Thom Tillis called for the Defense Secretary to be fired and said he had never seen more inept management of American servicemembers. The Army Secretary has resigned. The Navy’s top admiral and the commanders responsible for Europe, Asia and Latin America told the Secretary of Defense directly that the deployment could not be sustained. It’s the reporters who wrote it down. And now, they’re the ones who are out. I know it’s easy to distrust information or news that conflicts with your beliefs. But there’s a difference between a press you distrust and a press the government gets to edit. The difference shows up exactly here: when the reporting is inconvenient, on a subject that costs you money, with a vote six weeks away. Verify every word they write. It’s not only your right but your obligation to hold the press accountable, as it holds the government accountable. “The press was to serve the governed,” wrote Supreme Court Associate Justice Hugo Black in the Pentagon Papers case, “not the governors.” The First Amendment forbids “the Government’s power to censor the press” so that “the press would remain forever free to censure the Government.” It is the duty of the press to “prevent any part of the government from deceiving” you. Just make sure you’re the one deciding what accurate information reaches you. Because right now Trump is making that call, and he’s making it on the theory that you’d change your mind if you knew. Trump Again Tests the First Amendment, This Time by Banning the Press from the White House

The First Amendment is under attack and rightfully so, the press is fighting back. CNN, MS NOW and POLITICO just went to federal court this morning after the White House revoked their press badges and just now the five major TV networks that operate the White House TV pool refused to replace CNN after the administration blocked it from carrying out scheduled duties.Over the weekend, I spoke with WTOP News in Washington, D.C., about this latest attack on the Fourth Estate. As a First Amendment lawyer, my reading of case law is straightforward: the D.C. Circuit says the White House Press Area is a nonpublic forum, but restrictions on access still must be reasonable and viewpoint neutral. President Trump has publicly said he's banning these organizations because he considers their coverage “fake news” and has characterized that reporting as a national-security threat. Excluding these news organizations because the president objects to their journalism is not reasonable, it most certainly is viewpoint discrimination and it's unconstitutional.Calling unfavorable journalism “fake news” or a national-security threat is the real hoax. Trump doesn't get to transform criticism of him into a censorship pass. That's precisely why the Founding Fathers wrote the First Amendment and now a federal court should admonish the president for doing violence to the Constitution. This is a public episode. Trump Lost Birthright Citizenship. But That’s Not the Whole Story.

In January 2025, a few days after President Trump signed his executive order attacking birthright citizenship, I wrote one of the first essays (https://israelbalderas.substack.com/p/my-grandmothers-bravery-and-the-battle)on this newsletter. It began with a sentence that was not really about law at all: My grandmother was very brave. I wrote those words because before I could explain the Fourteenth Amendment (https://www.archives.gov/milestone-documents/14th-amendment), before I could talk about United States v. Wong Kim Ark (https://supreme.justia.com/cases/federal/us/169/649/), before I could analyze executive power or constitutional text, I needed readers to understand what this issue meant in human terms. In 1948, my grandparents left Juchipila, Zacatecas, Mexico, and moved to Juárez, just across the border from El Paso, Texas. They opened a small convenience store — an abarrotes — and tried to build something better for their family. My uncle was born in Juárez. But when my grandmother was pregnant with my mother, she made a decision that changed the trajectory of our family. A month before my mother’s birth, she crossed into El Paso and stayed with her sister. In January 1949, my mother was born on American soil. Because of the Fourteenth Amendment, she became an American citizen. That one act of courage set in motion everything that followed. My mother grew up as an American citizen. She later helped her parents gain legal residency. She earned a master’s degree in education while raising my sister and me as a single parent. My sister became an immigration attorney. I became a lawyer, a professor, and someone who teaches students why constitutional words matter. So when President Trump signed an executive order on his first day back in office declaring that some children born in the United States would no longer be treated as citizens, I did not see it as an abstract policy fight. I saw it as a direct challenge to families like mine. Yesterday, the Supreme Court answered that challenge. In Trump v. Barbara, the Court struck down the executive order and held that children born in the United States to parents who are unlawfully or temporarily present are citizens at birth under the Fourteenth Amendment. Chief Justice John Roberts wrote the majority opinion, joined in full by Justices Sonia Sotomayor, Elena Kagan, Amy Coney Barrett, and Ketanji Brown Jackson. Justice Brett Kavanaugh agreed the order was unlawful under federal statute, though he did not join the constitutional holding. Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch dissented. (CBS News (https://www.cbsnews.com/news/supreme-court-birthright-citizenship-trump-decision/)) The headline is simple: Trump lost. But the story underneath the headline is bigger than that. The Supreme Court did not create a new right. It did not invent a new theory of citizenship. It did not hand immigrants some new benefit that had never existed before. It reaffirmed the constitutional promise that has stood since the Fourteenth Amendment: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof,” are citizens. That promise was born out of one of the darkest chapters in American law. The Fourteenth Amendment was written in the shadow of Dred Scott, the 1857 decision that said Black Americans could not be citizens. The Citizenship Clause was a rejection of that world. It rejected the idea that citizenship depends on bloodline, caste, ancestry, or whether those in power believe your family truly belongs. That is why this case matters so much. Trump’s executive order tried to do by presidential command what the Constitution does not permit. The order said citizenship would not automatically extend to a child born in the United States when the mother was unlawfully present and the father was not a citizen or lawful permanent resident, or when the mother was lawfully but temporarily present and the father was not a citizen or lawful permanent resident. (The White House (https://www.whitehouse.gov/presidential-actions/2025/01/protecting-the-meaning-and-value-of-american-citizenship/)) Read that carefully. The executive order did not simply target immigration policy. It tried to make the legal status of the parent determine the constitutional identity of the child. That is the line the Court refused to cross. The mother may still be undocumented. The father may still lack lawful permanent status. Immigration law still applies. Nothing about the ruling erases the government’s power to enforce immigration laws. But the child born here is a citizen. That is the point. The Court protected the child from being made legally homeless because of the parent’s status. Had the Court gone the other way, it would have opened the door to a permanent underclass: children born here, raised here, educated here, subject to American laws, but denied membership in the only country they have ever known. That is not just a legal problem. That is the architecture of caste. And that is why Roberts’ opinion is so important. He does not just recite doctrine. He walks through the history and shows that the anti-birthright-citizenship argument has always depended on the same fear: that some people are too foreign, too different, too culturally alien to become one of us. In the late nineteenth century, the target was Chinese immigrants. In Wong Kim Ark, the Supreme Court held that a man born in San Francisco to Chinese parents was a citizen under the Fourteenth Amendment. The country had been told then, too, that these families could never truly belong. The Court rejected that argument then. It rejected it again yesterday. Roberts’ most powerful sentence may be this one: “Citizenship, then and now, was the right to have rights — to freely participate in our political community.” (CBS News (https://www.cbsnews.com/news/supreme-court-birthright-citizenship-trump-decision/)) That is what my grandmother understood before she could have put it in constitutional terms. She understood that citizenship is not just paperwork. It is possibility. It is protection. It is the legal foundation on which a family can build a future. And this is where the political reaction becomes revealing. Parts of the right are furious — not because the Court changed the law, but because it refused to change the law for them. Some Republican and conservative figures described the ruling as a betrayal, an attack on sovereignty, or a disaster for the country. (The New Republic (https://newrepublic.com/post/212543/republican-reaction-supreme-court-ruling-birthright-citizenship?utm_source=chatgpt.com)) Vice President J.D. Vance reportedly called the decision “preposterous” while also pointing to a “silver lining” in the closeness of the constitutional vote. (New York Post (https://nypost.com/2026/06/30/us-news/vance-argues-there-is-a-big-silver-lining-in-supreme-courts-preposterous-ruling-in-birthright-citizenship-case/?utm_source=chatgpt.com)) That backlash tells us something important. For years, conservatives have told the country that judges should follow the text, follow the history, and resist the temptation to rewrite the Constitution based on policy preferences. Fine. Then look at this case. The text says “all persons born.” It does not say “all persons born to lawful parents.” It does not say “all persons born to domiciled parents.” It does not say “all persons born to parents the president considers sufficiently attached to the United States.” Those extra words came from the executive order, not from the Constitution. So when Chief Justice Roberts and Justice Barrett followed the text and history to a result that angered the political right, the reaction was immediate. They were not treated as judges applying a conservative legal method. They were treated as traitors to a political cause. That is the real warning sign. A justice is not supposed to be loyal to the president who appointed her. A court is not supposed to serve the movement that celebrates its confirmations. The oath is to the Constitution. That used to be the whole point. To be clear, this ruling does not end the fight. Trump has already urged Congress to act, claiming that no “long and unwieldy Constitutional Amendment” is necessary. But that claim runs into the basic problem created by the Court’s majority: if the Fourteenth Amendment itself guarantees birthright citizenship, Congress cannot erase that guarantee by ordinary legislation. (CBS News (https://www.cbsnews.com/news/supreme-court-birthright-citizenship-trump-decision/)) That is why Kavanaugh’s separate opinion matters. He agreed the executive order violated federal law, but he would have avoided the constitutional question and left Congress more room to act. Roberts, Barrett, and the Court’s three liberal justices went further. They said the Constitution itself protects the citizenship of these children. (CBS News (https://www.cbsnews.com/news/supreme-court-birthright-citizenship-trump-decision/)) So yes, the ruling was 6–3 in judgment. But constitutionally, the center of gravity was 5–4. That should sober everyone up. Birthright citizenship survived. But it survived by a narrower constitutional margin than many Americans probably realize. Three justices would have allowed the executive order to stand at least in significant part. A fourth would have struck it down only under federal statute while leaving Congress room to try again. So this was a victory. But it was also a warning. The question underneath this case is not going away. It is the same question I asked in January 2025 when I wrote about my grandmother. Who counts as American? Is America a place you belong to because of an idea, or because of your bloodline? My grandmother answered that question with her courage. The Fourteenth Amendment answered it after the Civil War. Wong Kim Ark answered it during the era of Chinese exclusion. And yesterday, in Trump v. Barbara, the Supreme Court answered it again. America is not supposed to be a bloodline. It is supposed to be a promise. My grandmother believed in that promise. She crossed a border carrying more than a child. She carried a hope that this country would be large enough, fair enough, and faithful enough to let her family become part of its story. Yesterday, the Supreme Court said that hope still counts. And for families like mine, that is not just constitutional law. That is our life. This is a public episode. The Democrats' Two-State Problem

Leading up to the Fall 2026 elections, you will see the Democratic Party try to run two opposite campaigns at the same time. In the end, it won’t work. In Maine, the message is all about the bro culture. Graham Platner, who just won the Democratic Senate nomination (https://www.axios.com/2026/06/10/democrats-graham-platner-maine-senate-primary), is being sold as the party’s answer to Donald Trump—a fighter who can’t (or I should say won’t) be embarrassed. Through primary day, he’s survived a parade of scandals, and thanks to his win, treats those scandals as evidence of his strength. The list of answerables is not exhaustive: sexist online posts, a chest tattoo that resembled a Nazi symbol, sexting while married, and troubling accounts from former partners are just a few of the life choices we know so far. Yes, he disputes some of it and denies the worst. But notably, he hasn’t apologized his way toward the center. Remember, toughness means shrugging it off. After his victory, he was brazen enough to tell a journalist the controversies have only “strengthened” his campaign. Like another supposed tough guy who’s schtick helped him get to the White House twice, Graham happily dismisses any reporting on his character flaws as a politically motivated attack. And his reward: the Senate Democratic leadership lined up behind him the morning after he won. The implicit theory is unmistakable. The answer to Trump, in Maine, is a tougher Trump of the party’s own. Now, the national pundits, the political establishment, they keep looking for that one story, that one headline, that one moment in my life that they can define the campaign by. But in trying so hard to understand me, they fail to understand that this is not about me at all. This is a movement about us. -Graham Platner Now drive south to Texas, and the political message inverts. There, the Democrats’ rising star, State Representative James Talarico, is selling the opposite product. His pitch is that strength has been misdefined—that leadership is not domination or humiliation or the hourly performance of toughness. Republicans have mocked him for it, questioning his masculinity (https://thehill.com/opinion/campaign/5910513-gop-attacks-talarico-masculinity/) and calling him too soft for Texas. (https://19thnews.org/2026/05/texas-senate-race-manliness-testosterone/) His response is that Texans are exhausted by the strongman act and hungry for something gentler: decency, service, a politician who does not need to make voters feel small in order to feel large. So which is it? Are American voters worn out by cruelty and starving for character, that would be the Texas pitch? Or has character stopped mattering, leaving only the question of who hits hardest, the Maine pitch? These are not two flavors of the same argument. They are contradictory accounts of what the electorate wants and what this political moment requires. And the Democratic party is making both, in two states, in the same election cycle, in public. It can’t be both. Here is where I think Democrats have made a deeper error than mere inconsistency, an error about the lesson they believe Trump taught. The Maine theory rests on a reading of the last decade that goes like this: Trump proved that character no longer matters, that a candidate can survive anything, that shamelessness is a kind of superpower. If that is the lesson, then the rational move is to build your own version of him and point it at the other side. But that misreads why Trump won. Trump never asked Americans to believe he was good. He asked them to believe he was theirs; a weapon aimed at people they feared more than they feared him. The voters who chose him were not retiring the idea of character. They were making a threat assessment. Yes, he’s reckless, they concluded, but the other side is worse. That’s not a verdict that character has ceased to matter. It’s a verdict about which danger to run from first. A gesture severed from its purpose was never the living thing to begin with. A Democratic Trump does not inherit Trump’s appeal; it merely hands Republicans the one argument Trump himself never had to answer and surrenders the very high ground the party is trying to claim eighteen hundred miles away in Texas. You can’t credibly campaign as the antidote to cruelty in one state while nominating its mirror image in another and expect voters to grade each race in isolation. They don’t live in isolation. Rather, they watch national news and they compare notes. And this is the part that should worry Democratic strategists most, because it’s not really about Platner, or Talarico, or any single nominee. Every party runs flawed candidates; voters forgive a great deal. You don’t usually lose an election by believing the wrong thing. You lose by believing two opposite things and hoping no one lines them up side by side. That’s the trap. When the Texas voter and the Maine voter finally compare what they were told, the thing they’ll notice is not a difference of regional emphasis. It’s that the party appears to have meant neither sermon—that it was saying whatever the room required. And that’s the one thing a character argument can’t survive, because the entire premise of “we’re better than this” is that you mean it when it is inconvenient. When it costs you a Senate seat. When it’s one of your own. The oldest test of a principle was never whether you apply it to your opponents. It’s whether you apply it to your allies. Over the next five months, Democrats are at risk of failing that test in front of the entire country and calling it strategy. Thanks for reading BEYOND THE TALKING POINTS! 'The Claw' on the White House Lawn

When President Donald J. Trump was asked recently about the UFC arena rising on the South Lawn of the White House, he reached for an unexpected historical comparison (https://www.pbs.org/newshour/politics/trump-compares-white-house-ufc-cage-to-eiffel-tower-says-maybe-well-never-ever-take-it-down). The Eiffel Tower, he noted, was originally intended to be temporary. Built for the 1889 World’s Fair in Paris, the structure was supposed to be dismantled after the exposition ended. Instead, it remained, eventually becoming perhaps the most recognizable symbol of France itself. Then Trump turned to the arena being constructed outside the Executive Mansion. “Maybe we’ll never ever take it down, (https://www.theguardian.com/sport/2026/jun/03/donald-trump-ufc-arena-white-house-permanent)” he said. Whether the remark was serious, sarcastic, or simply another improvisational Trumpian riff hardly matters. What matters is that his mind instinctively connected a temporary UFC arena nicknamed “The Claw” to one of the world’s great national monuments. Such comparison is absolutely absurd. Strangely, it’s also revealing. “…you know we’re building something in front of the White House that’s quite attractive to a lot of people….and I’m looking at it and maybe we’ll never ever take it down.” President Donald Trump likening “The Claw” to the Eiffel Tower. (https://www.tiktok.com/@realdonaldtrump/video/7646865974712470815?lang=en) The Eiffel Tower was built to showcase French engineering, industrial achievement, and national ambition at the height of the nineteenth century. The structure rising on the White House lawn was designed by UFC CEO Dana White to host a cage fight. Yet both, in Trump’s telling, belonged to the same category: spectacles that attract attention. (https://www.hollywoodreporter.com/business/business-news/inside-ufc-white-house-fight-dana-white-details-1236611686/) That distinction may explain why the image of a UFC cage standing beside the White House has generated such strong reactions. The fight itself is almost beside the point. The more interesting question is what Americans believe the White House is supposed to represent. I found myself thinking about that question after making what I assumed was an innocuous joke on Facebook. News reports about the UFC event had already saturated social media, and the story seemed almost impossible to parody. There would be thousands of spectators, military guests, enormous television audiences, and enough staging equipment to transform one of the country’s most recognizable civic spaces into something resembling a championship fight venue. So I wondered aloud whether we should simply embrace the concept. Why Stop At UFC? “Honestly,” I posted on Facebook, “there’s a lot of untapped potential here. If we’re going all in, why stop at UFC?” Why not stock the newly renovated Reflecting Pool (https://apnews.com/photo-gallery/lincoln-memorial-reflecting-pool-renovation-photo-gallery-ad66a11c12cd17d2a92deb6a312585ac) with bass and allow Bass Pro Shops to sponsor a fishing tournament. Or maybe, we can hold a monster-truck rally near the Rose Garden. “What other events should we turn the White House into?” I asked my Facebook audience. The first responses arrived exactly as intended. Friends offered increasingly ridiculous suggestions. Someone proposed sprint-car races around the Washington Monument. Another transformed the White House into a carnival midway through a digitally altered image. For a brief moment, Americans were doing what Americans have traditionally done best: laughing at themselves. Then the mood changed. As evidenced by the screen grab posted above from my Facebook page, ,ore than one hundred people responded to the post, with a surprising number of them quite furious. Not about the UFC fight itself but about the joke. The comments quickly migrated from fishing tournaments and monster trucks to drag queens, Joe Biden, cultural elites, patriotism, and the grievances of the past decade. One commenter informed me that my post was the dumbest thing he had read all day. Another suggested that liberals should die. What fascinated me was not the caustic anger directed at what appeared to be a humorous post. Rather, tt was the target of the anger. Almost nobody wanted to discuss the UFC event. The cage was everywhere in the conversation and nowhere in it at the same time. The real argument over “The Claw” concerned identity. For some Americans, the White House hosting a UFC fight represents the democratization of an institution long associated with elite culture. For others, it represents the conversion of a civic symbol into entertainment. What appeared at first to be a debate about a sporting event quickly revealed itself to be a debate about belonging, status, and who gets to define American culture. The UFC fight is not the story. The story is what Americans see when they look at it. Some see a celebration, while others see a warning, and still others see a joke. What almost everyone sees is themselves. That may be why Trump’s Eiffel Tower comparison lingered in my mind long after I first read it. Monuments tell us something about the societies that build them. They reveal what a culture admires, what it values, and what it hopes future generations will remember. The Eiffel Tower became a monument because France wanted the world to see its ingenuity. The question raised by “The Claw” on the South Lawn of White House is simpler and more unsettling. What does America want the world to see now? Thanks for reading BEYOND THE TALKING POINTS! The First Amendment Warning America Is Ignoring

At first glance, this may look like a conversation about religion and politics. I think it’s actually a much bigger conversation about democracy itself and what happens when political power starts sounding sacred. I’ve been thinking a lot about the role of religion in public life, especially in a free society that cherishes freedom of expression. Not because I’m uncomfortable with religion in public life. I’m not. In fact, I think the First Amendment strongly protects religious expression, and I think the Supreme Court has often been right to push back when governments become openly hostile to faith. But I do think there’s a dangerous line democracies can cross when political leaders begin sounding spiritually untouchable; when criticizing politicians starts feeling almost immoral, disloyal or dare I say, blasphemous. That’s very different from religious freedom. And historically, free societies get into trouble when political power starts wrapping itself too tightly in sacred language and imagery. The First Amendment protects freedom of religion. But it also protects the freedom to question power, disagree openly, and live as equal citizens even when we believe radically different things. That tension—between faith, freedom, and political power—may be one of the most important conversations America needs to have right now. Thanks for reading BEYOND THE TALKING POINTS! TikTok, Porn-gating and the First Amendment: How 2025 Rewired Free Speech

Beyond the First Podcast, with First Amendment scholar Chris Terry. I’m going to say something that sounds dramatic, but I mean it plainly: 2025 is the year the internet’s First Amendment footing started to shift. It’s not because speech disappeared or because the government passed one giant “censorship law.” But because the Supreme Court signaled - quietly and almost politely - that the internet may no longer get the kind of “newspaper-level” protection many of us have assumed since the late 1990s. And once that protection starts wobbling, everything else gets easier to regulate. If you felt this year like free speech became less “a right” and more “terms and conditions apply,” you’re not crazy. What you’re noticing is a structural change. In my latest Beyond the First podcast episode, I talk with my friend, and University of Minnesota media law scholar, Chris Terry about why the Supreme Court’s decision in Free Speech Coalition v. Paxton is being mis-sold to the public. Most people hear: “Oh, that’s the porn case.” Texas passed an age verification law so kids can’t access adult sites. End of story, right? Common sense. Protect children. Move on. But that’s not what makes this case consequential. So if you want to understand what actually changed in 2025, and what’s about to get tested in 2026, sit down and listen. This episode will give you the framework, not just the headlines. And I promise: you’ll walk away with better questions. This is a public episode. Beyond the First: The Hollywood Spin Machine – Who Controls the Truth?

Hollywood isn’t just about making movies—it’s about crafting narratives, both on-screen and off. In previous episodes of Beyond the First, we’ve explored the Blake Lively v. Justin Baldoni legal battle (https://www.independent.co.uk/arts-entertainment/films/news/blake-lively-justin-baldoni-lawsuit-court-documents-text-messages-b2686766.html) and the larger implications of defamation in the digital age. * In (https://open.substack.com/pub/israelbalderas/p/beyond-the-first-suing-for-the-spotlight?r=dxco9&utm_campaign=post&utm_medium=web&showWelcomeOnShare=false)Episode 4 (https://open.substack.com/pub/israelbalderas/p/beyond-the-first-suing-for-the-spotlight?r=dxco9&utm_campaign=post&utm_medium=web&showWelcomeOnShare=false), we analyzed the legal mechanics of defamation, breaking down the claims at the heart of Lively and Baldoni’s lawsuit and discussing how courts determine reputation harm in high-profile cases. * In (https://open.substack.com/pub/israelbalderas/p/beyond-the-first-the-it-ends-with-us-lawsuit?r=dxco9&utm_campaign=post&utm_medium=web&showWelcomeOnShare=false)Episode 7 (https://open.substack.com/pub/israelbalderas/p/beyond-the-first-the-it-ends-with-us-lawsuit?r=dxco9&utm_campaign=post&utm_medium=web&showWelcomeOnShare=false), we shifted focus to the power of social media, examining how viral narratives can sway public perception long before a judge or jury ever weighs in. Now, in Episode 10, we take the conversation further—diving into Hollywood’s PR machine (https://www.huffpost.com/entry/blake-lively-justin-baldoni-lawsuits-celebrity-pr-tactics_n_678ad1d6e4b0aa5a1d95cb24) and how public relations strategies often matter more than legal arguments in shaping the outcome of celebrity scandals. The Power of the PR Machine Joining me for this discussion are Lily M. Shall, Georgia Brucato, and special guest Jennifer Nassour (https://www.pocketbookproject.org/team-member/jennifer-a-nassour-esq), a political analyst (https://www.wgbh.org/news/politics/2024-07-09/republican-never-trump-voters-lack-good-options-former-mass-gop-chair-says), former journalist (https://www.newsmax.com/politics/economy-income-jeffries/2024/06/11/id/1168320/), and host of the Political Contessa (https://www.politicalcontessa.com/) podcast (https://podcasts.apple.com/us/podcast/political-contessa/id1588917810). Together, we unpack how crisis PR, media manipulation, and social media algorithms shape what the public perceives as truth. We examine how viral narratives—often driven by snippets of interviews, selectively edited videos, and carefully placed leaks (https://www.threads.net/@sanikakelkar/post/DD_XT0sIwtg/social-media-has-transformed-pr-from-a-behind-the-scenes-function-into-a-highly-)—can make or break a celebrity’s reputation. As Georgia and Lily point out, social media platforms like TikTok have become the primary news source for many young audiences, making it easier than ever for PR teams to control narratives while bypassing traditional journalism. Jennifer brings a political perspective, drawing parallels between Hollywood’s PR machine and the spin tactics used in political campaigns (https://www.nytimes.com/2024/12/21/business/media/blake-lively-justin-baldoni-it-ends-with-us.html). (https://www.nytimes.com/2024/12/21/business/media/blake-lively-justin-baldoni-it-ends-with-us.html) She argues that as journalism budgets shrink and social media platforms amplify selective messaging, the line between (https://journalistsresource.org/politics-and-government/fake-news-conspiracy-theories-journalism-research/)fact (https://journalistsresource.org/politics-and-government/fake-news-conspiracy-theories-journalism-research/) and (https://journalistsresource.org/politics-and-government/fake-news-conspiracy-theories-journalism-research/)framing (https://journalistsresource.org/politics-and-government/fake-news-conspiracy-theories-journalism-research/) continues to blur (https://journalistsresource.org/politics-and-government/fake-news-conspiracy-theories-journalism-research/). From Depp v. Heard to Lively v. Baldoni – The Evolution of Media Trials The Blake Lively v. Justin Baldoni legal dispute echoes themes we’ve seen before—most notably in the Johnny Depp v. Amber Heard (https://www.theguardian.com/commentisfree/2025/jan/04/blake-lively-justin-baldoni-depp-heard) trial. As Lily reflects, social media was flooded with content favoring Depp, painting Heard as a manipulative villain. However, when she later watched the Netflix documentary Depp v. Heard, she realized how much evidence had been omitted from her TikTok feed. This raises an unsettling question: Are celebrity lawsuits still about justice, or are they media spectacles designed to sway public opinion? And if social media users are consuming only curated versions of events, is there any room for an objective truth (https://www.nytco.com/press/journalisms-essential-value/)? The Legal and Ethical Stakes Beyond the PR battle, this case also raises critical legal questions about defamation law in the digital era (https://journals.library.columbia.edu/index.php/lawandarts/announcement/view/683). As Jennifer points out, former President Donald Trump has made loosening defamation protections a priority, and some Supreme Court justices have signaled interest in reconsidering (https://knightcolumbia.org/blog/the-enduring-significance-of-new-york-times-v-sullivan#:~:text=Sarah%20Palin's%20Fight%20Against%20the,reconsider%20Sullivan%20and%20its%20progeny.)New York Times v. Sullivan (https://knightcolumbia.org/blog/the-enduring-significance-of-new-york-times-v-sullivan#:~:text=Sarah%20Palin's%20Fight%20Against%20the,reconsider%20Sullivan%20and%20its%20progeny.), the landmark ruling that makes it harder for public figures to win defamation lawsuits. Meanwhile, Georgia questions whether celebrity defamation cases should be treated differently from those involving private individuals—since the damage to a public figure’s career can be immense, even if the legal standard for proving defamation remains high. Who Wins in the Court of Public Opinion? At the heart of the discussion is a bigger concern: In a world where perception is power, does the truth still matter? Hollywood and political elites have long known how to shape narratives, but social media algorithms have taken reputation management to an entirely new level (https://www.fastcompany.com/91204923/the-future-of-online-reputation-management-in-the-ai-era). Lily argues that cancel culture has left celebrities with little room for error—where a single viral moment can redefine their public image overnight. Meanwhile, Jennifer warns that journalism itself is at risk, as fewer reporters engage in investigative work (https://www.washingtonpost.com/business/2024/07/12/news-reporters-journalism-jobs-census/), instead relying on social media trends to drive coverage. How This Episode Expands the Conversation Our previous discussions on defamation law and the social media impact on reputation set the foundation for understanding the legal stakes of the Lively v. Baldoni case. But this episode takes the conversation further by exploring: * The influence of Hollywood PR firms in shaping media coverage * How social media amplifies crisis PR narratives while limiting investigative journalism * The lasting impact of media trials on defamation law and celebrity culture As Jennifer notes, “whichever PR machine is bigger and better—that’s the side that wins.” And in today’s digital media landscape, where TikTok trends replace courtroom facts (https://www.tiktok.com/@rob_law_kc/video/7437411447124004128), public figures can often weaponize public perception as a legal strategy (https://blog.vinesight.com/blog/the-ultimate-guide-to-managing-public-perception-and-protecting-your-brand-identity). (https://blog.vinesight.com/blog/the-ultimate-guide-to-managing-public-perception-and-protecting-your-brand-identity) Join the Conversation Hollywood’s PR machine isn’t slowing down—and neither is the public’s appetite for scandal. But if we want to be informed consumers of news and entertainment, we need to think critically about who is shaping the narratives we believe. Beyond the First: Art vs. Algorithm – Is AI Killing Human Imagination?

The rise of artificial intelligence has sparked a revolution in creative industries (https://www.theatlantic.com/sponsored/google/creator-economy/3959/), from film and music to digital art and design. AI can generate stunning images, compose music, and even write scripts in mere seconds. But as these technologies advance, so do the ethical and legal dilemmas surrounding them. When human expression meets machine learning, fundamental questions emerge: Is AI expanding artistic possibilities (https://www.weforum.org/stories/2024/12/art-of-being-human-creativity-digital-age/), or is it merely mimicking and repackaging human creativity? In this episode of Beyond the First, I sit down with two students from my Media Law and Ethics class, to explore how AI is reshaping creative fields (https://www.forbes.com/councils/forbescommunicationscouncil/2024/06/28/creative-economy-20-how-ai-is-reshaping-the-role-of-creative-agencies/). We discuss whether AI-generated works deserve copyright protection, the threat automation poses to artists, and whether these tools are empowering or erasing human ingenuity. When AI Holds the Brush, Who Signs the Canvas?" 🎨 Originality Redefined (https://eudoxuspress.com/index.php/pub/article/view/1739?articlesBySimilarityPage=3) – AI-generated art, film, and music flood creative industries, but is it truly original or just an advanced form of imitation? ⚖️ Authorship on Trial (https://www.morganlewis.com/pubs/2024/05/dueling-briefs-filed-over-human-authorship-requirement-for-us-copyright-registration) – Copyright law assumes human intent and creative expression. But when machines remix existing works, who deserves credit— the programmer, the AI, or no one at all? 🚨 The Future of Creativity (https://www.weforum.org/stories/2025/01/artificial-intelligence-must-serve-human-creativity-not-replace-it/) – As AI reshapes artistic production, industries face a choice: embrace AI as a tool or fight to preserve human artistry in a world increasingly dominated by algorithms. 💬 Where do we draw the line between innovation and artistic theft? And if AI can create, what does that mean for the future of human expression? At the heart of this debate lies a core legal principle: Copyright law is built on the idea that an original work of authorship is entitled to protection (https://www.copyright.gov/comp3/chap300/ch300-copyrightable-authorship.pdf). But in an era where AI generates paintings, films, and even music at the click of a button, what counts as "originality"—and who qualifies as the author? Traditional copyright frameworks assume human intent, skill, and creative expression—elements that AI challenges by remixing vast datasets of existing works. As AI-generated content floods creative industries, the legal and ethical boundaries of authorship are becoming increasingly blurred, raising urgent questions about ownership, attribution, and artistic value (https://www.forbes.com/councils/forbestechcouncil/2024/05/21/beyond-imagination-ai-art-and-the-ownership-dilemma/). Meanwhile, artists and designers are grappling with an unsettling reality—companies are already replacing human creators with AI, raising concerns about fair compensation and the devaluation of original work. Tech developers argue that AI is just another tool, no different than a camera or a paintbrush. But where do we draw the line between inspiration and imitation? And can creative industries survive if AI-generated content saturates the market? Join us as we unpack the legal, ethical, and philosophical tensions at the heart of this debate. In a world where machines can now “create,” we ask: What is the future of art, and who gets to define it? Listen, Subscribe, and Join the Conversation. This is a public episode. Beyond the First: Tracked, Targeted, and Manipulated – The Hidden Cost of Free Speech

Every time you go online, your data is being collected, analyzed, and sold (https://hai.stanford.edu/news/privacy-ai-era-how-do-we-protect-our-personal-information)—often without your full awareness. The concept of “surveillance capitalism,” popularized by Harvard Professor Shoshana Zuboff (https://www.youtube.com/watch?v=0dBFvX7txeA), describes this phenomenon where personal data is extracted and monetized on an unprecedented scale. From search history to social media interactions, your digital footprint fuels an industry built on surveillance and influence. But if data is power, then who really holds it? Companies track, collect, and monetize our data at an unprecedented scale, shaping everything from the ads we see to the content we consume. But as surveillance capitalism expands, fundamental questions arise: Does free speech truly exist when every click, search, and conversation is monitored? And can personal autonomy survive when data collection dictates our choices? In this episode of Beyond the First, I sit down with two students from my Media Law and Ethics class, to explore the tension between privacy rights, data collection, and free expression (https://globalfreedomofexpression.columbia.edu/wp-content/uploads/2023/01/Privacy-and-Freedom-of-Expression-4.pdf). We discuss how surveillance capitalism shapes online speech and encourages self-censorship, whether tech companies wield too much control over personal autonomy, and the legal and ethical debates surrounding government and corporate data collection. Together, we unpack the implications of a world where digital footprints are constantly tracked and monetized. Privacy advocates argue that mass data collection creates a chilling effect, where individuals hesitate to speak freely, fearing surveillance or algorithmic consequences. At the same time, companies defend data collection as essential for personalized experiences and business innovation. So where do we draw the line between security, profit, and freedom? Your Data, Their Power: Living in the Age of Digital Surveillance 🔍 The Trail – Every online action leaves a trace—your clicks, searches, and conversations become part of an invisible data stream. But who’s watching (https://theconversation.com/surveillance-is-pervasive-yes-you-are-being-watched-even-if-no-one-is-looking-for-you-187139)? 💰 The Transaction – Your digital footprint isn’t just information—it’s a commodity. Tracked, analyzed, and sold (https://www.politico.com/news/magazine/2024/02/28/government-buying-your-data-00143742), your personal data fuels an industry designed to predict, influence, and profit from your every move. 🔗 The Control – As surveillance capitalism expand (https://www.youtube.com/watch?v=afOWUuimwOI)s, the lines between autonomy and manipulation blur. Are you truly free online, or are unseen forces shaping what you see, think, and do? 💬 If data is power, who really owns your digital life? Beyond the First: The 'It Ends With Us' Lawsuit – When PR Fights Matter More Than Courtroom Battles

High-profile lawsuits aren’t just fought in the courtroom—they’re litigated in the media and the court of public opinion. The legal battle surrounding It Ends With Us (https://www.brit.co/blake-lively-justin-baldoni-legal-battle/) is a prime example of how defamation cases unfold in the digital age (https://news.northwestern.edu/stories/2024/04/northwestern-law-hosts-panel-on-how-social-media-is-changing-defamation-law/), where narratives are shaped as much by public relations strategies as they are by legal arguments. But what happens when reputation management collides with free speech? And how does media coverage influence the outcome of defamation cases? In this episode of Beyond the First, I sit down with two students from my Media Law and Ethics class, to dissect the defamation controversy surrounding It Ends With Us. We explore how legal claims of libel and reputational harm (https://www.wxow.com/news/freedom-of-expression-or-reputational-harm/article_5e2e97cc-5a87-11ef-9f87-f3e85d2ae16f.html) intersect with Hollywood PR tactics (https://www.nytimes.com/2024/12/26/opinion/blake-lively-justin-baldoni.html), social media narratives, (https://www.newyorker.com/culture/annals-of-inquiry/we-know-less-about-social-media-than-we-think) and the evolving role of journalism in covering lawsuits (https://journalism.university/reporting-techniques/crucial-role-legal-reporting-journalism/). (https://journalism.university/reporting-techniques/crucial-role-legal-reporting-journalism/) Defamation law traditionally seeks to balance free speech and personal reputation, but in the era of viral misinformation and online speculation, that balance has become increasingly difficult to maintain. Is the law equipped to handle fast-moving digital narratives, or are reputations destroyed long before the legal system can intervene? We’ll analyze the key legal issues at play, examine past celebrity defamation cases, and discuss whether today’s defamation lawsuits are about truth—or about controlling the public narrative. Beyond the First: The Ethics of AI – Who’s Programming the Future?

Artificial Intelligence is no longer a futuristic fantasy—it’s here, shaping industries, influencing decisions, and redefining what it means to be human. But as AI tools become more powerful, ethical concerns are emerging at an alarming rate (https://news.asu.edu/20240715-law-journalism-and-politics-ethical-costs-advances-ai). Can AI truly be ethical, or does it simply reflect the biases of its creators? Who should be held accountable when AI makes decisions that impact society? And as automation expands, will AI take over jobs, or will it force us to redefine the workforce? In this episode of Beyond the First, I sit down with two students from my Media Law and Ethics class, to tackle the complex ethical dilemmas surrounding AI. After all, they will be the ones grappling with this issue (https://www.forbes.com/councils/forbestechcouncil/2023/10/20/gen-z-will-shape-the-age-of-ai/)in the coming years. We explore AI’s impact on job markets, particularly in communication design, where AI tools are both enhancing productivity and increasing competition. We also examine AI-generated biases, its influence on decision-making, and the ongoing debate over AI’s role in (https://sloanreview.mit.edu/article/how-genai-changes-creative-work/)creative and professional fields (https://sloanreview.mit.edu/article/how-genai-changes-creative-work/). (https://sloanreview.mit.edu/article/how-genai-changes-creative-work/) The conversation highlights the urgent need for ethical guidelines (https://www.alvarezandmarsal.com/insights/ai-ethics-part-one-navigating-pressures-responsible-ai#:~:text=As%20AI%20systems%20become%20more,are%20developed%20and%20deployed%20responsibly.) in AI (https://www.alvarezandmarsal.com/insights/ai-ethics-part-one-navigating-pressures-responsible-ai#:~:text=As%20AI%20systems%20become%20more,are%20developed%20and%20deployed%20responsibly.) development. Should AI ethics be standardized across industries, or should regulations be sector-specific? We dive into real-world examples, from AI-driven hiring algorithms that reinforce discrimination to AI-generated journalism that blurs the line between fact and fiction. With governments and corporations struggling to regulate AI (https://restofworld.org/2025/global-ai-regulation-big-tech/#:~:text=Big%20AI%20companies%20like%20Google,leaders%20in%20many%20other%20countries.), the question remains: Can we ensure AI serves humanity without causing unintended harm? Should AI be treated as a tool, a collaborator, or something more? And as AI’s influence grows, how can we prevent it from deepening societal inequalities? Join us for a thought-provoking discussion on bias, accountability, and the battle over AI’s moral code. Beyond the First: Viral Accusations, Digital Lies, and the Death of Reputation

The internet has redefined communication, but it has also reshaped the way reputations are built—and destroyed. In today’s digital world, a single tweet, viral video, or misleading headline can cause irreparable harm. (https://www.nytimes.com/2024/06/17/opinion/social-media-health-warning.html) How do defamation laws apply in an era where falsehoods can spread faster than the truth? Has technology made it harder to differentiate between free speech and reputational harm? And should legal protections evolve to address these new realities? In this episode of Beyond the First, I sit down with two students from my Media Law and Ethics class, to explore how modern defamation cases are being shaped by digital platforms, social media, and emerging AI-generated content. We discuss how online accusations, viral misinformation, and the lack of editorial oversight on social media create a new frontier for defamation law. The consequences of viral misinformation extend beyond legal disputes. According to a study from 2022 by The Digital Wellness Lab’s Pulse Survey, "Adolescent Media Use: Attitudes, Effects, and Online Experiences (https://digitalwellnesslab.org/wp-content/uploads/Pulse-Survey_Adolescent-Attitudes-Effects-and-Experiences.pdf)," there is a growing body of evidence linking excessive social media use to a mental health crisis among young people. Adolescents who spend more than three hours a day on social media face double the risk of anxiety and depression, and as of summer 2023, the average daily use in this age group had reached 4.8 hours, according to Gallup (https://news.gallup.com/poll/512576/teens-spend-average-hours-social-media-per-day.aspx). Additionally, nearly half of teenagers report that social media negatively affects their body image. With reputations and mental well-being on the line, how should society balance the benefits of digital platforms with the risks of misinformation and reputational harm? Unlike traditional defamation cases involving newspapers or television, digital defamation often occurs without professional editorial control, making it harder to track, regulate, or correct false information. How should legal frameworks adapt to this new reality? Is the legal system equipped to provide justice to those harmed online, or is reputation damage in the digital space just an unavoidable risk? Building on the themes of celebrity lawsuits, media influence, and reputation management, this episode expands the discussion into how ordinary people can find themselves caught in the crossfire of cancel culture, digital rumors, and viral defamation. Beyond the First: Suing for the Spotlight – The ‘It Ends With Us’ Defamation Drama

In Hollywood, lawsuits often unfold like carefully scripted dramas, with every legal filing, public statement, and media leak contributing to a narrative that plays out in front of millions. The ongoing defamation dispute between Blake Lively and Justin Baldoni (https://variety.com/2025/film/news/blake-lively-justin-baldoni-legal-feud-explained-1236283457/) over the It Ends With Us film is no exception. While the case raises serious legal questions, it also highlights how public figures (https://deadline.com/2025/01/blake-lively-justin-baldoni-gag-order-1236266991/) strategically use the law, media, and public relations to control the storyline. (https://variety.com/2025/film/news/blake-lively-justin-baldoni-legal-feud-explained-1236283457/) In this episode of Beyond the First, I sit down with two students from my Media Law and Ethics class, to analyze how defamation law applies in the entertainment industry, and whether celebrities today are more concerned with protecting their reputations or shaping public perception. How does the law differentiate between fair criticism and harmful falsehoods? When do media narratives cross the line from reporting to reputation destruction? And does the legal system even stand a chance in the face of viral social media storms We examine the Blake Lively v. Justin Baldoni lawsuit, break down past high-profile defamation case (https://www.nytimes.com/news-event/johnny-depp-amber-heard-trial)s, and discuss what these legal battles mean for Hollywood, journalism, and everyday social media users. With celebrity feuds increasingly being fought as much in courtrooms as they are on Twitter and Instagram, (https://www.sheknows.com/entertainment/slideshow/2373468/famous-celebrity-family-feuds/) this episode takes a closer look at the intersection of free speech, defamation law, and the power of media narratives. Beyond the First: Free Speech Under Fire – Book Bans, Campus Speech, and Government Censorship

From banned books to campus speech restrictions, debates over the limits of free expression continue to shape American society. As government officials push for more control over classroom content and public institutions wrestle with how to regulate controversial speech, the boundaries of the First Amendment are being tested in new and complex ways. In this episode of Beyond the First, I sit down with two Elon University students from my Media Law and Ethics class, to explore the legal and ethical implications of these free speech controversies. What happens when governments restrict what can be taught in schools? Do campus speech policies protect marginalized voices, or do they stifle open debate? And how do these policies align with the First Amendment’s core protections? We break down the latest legal battles over book bans (https://www.ala.org/bbooks/book-ban-data), examine how public universities handle controversial speakers (https://www.thefire.org/research-learn/lesson-campus-speakers-and-counter-protests#:~:text=As%20a%20public%20university%2C%20like,of%20what%20they%20might%20say.), and discuss whether government oversight of speech is ever justified (https://www.thefire.org/news/arguments-freedom-many-reasons-why-free-speech-essential). Beyond the First: The TikTok Ban – National Security or Political Theater?

The U.S. government has long debated the potential ban of TikTok, citing national security risks. But how much of this is about genuine concerns over data privacy, and how much is political theater? In the second episode of Beyond the First, we examine whether the push to regulate TikTok is rooted in national security concerns or if it’s simply a convenient way for lawmakers to exert control over digital platforms. Joining me for this discussion are two Elon University students from my Media Law and Ethics class, who have been exploring the constitutional implications (https://www.aclu.org/news/national-security/banning-tiktok-is-unconstitutional-the-supreme-court-must-step-in) of banning TikTok (https://www.aclu.org/news/national-security/banning-tiktok-is-unconstitutional-the-supreme-court-must-step-in), the broader debate over government regulation of social media (https://crsreports.congress.gov/product/pdf/R/R45650), and whether such measures could set a dangerous precedent for free speech. We break down the key arguments from lawmakers, examine what the U.S. Supreme Court held in TikTok v. Garland, and other recent legal challenges facing past attempts to regulate social media platforms, and question whether TikTok is truly a national security threat or just the latest political scapegoat (http://political scapegoat.). Beyond the First: Who Owns Creativity in the Age of AI?

Artificial intelligence is no longer a futuristic concept—it’s here, shaping industries and redefining creativity. As AI-generated content floods the internet, legal battles over copyright and ethical dilemmas around artistic integrity are intensifying. Can an AI truly create? Who owns the work it generates? And is the rapid rise of AI in creative industries a revolution or an existential threat to human artists? In the inaugural episode of Beyond the First, I sit down with two insightful Elon University students from my Media Law and Ethics Winter Term class, to break down the legal and ethical issues surrounding AI and copyright. We explore the growing concerns of artists (https://hbr.org/2023/04/generative-ai-has-an-intellectual-property-problem), the challenges facing lawmakers (https://www.ncsl.org/state-legislatures-news/details/challenges-ahead-for-lawmakers-seeking-to-legislate-ai-in-campaigns), and whether the legal system can keep pace with technological advancements (https://hls.harvard.edu/today/is-the-law-playing-catch-up-with-ai/). From high-profile lawsuits to debates over fair use, our discussion delves into the murky waters of AI-generated content. Should AI art be eligible for copyright protection? Or does it undermine human creativity by repurposing existing works? Trey and Carina bring fresh perspectives to this pressing issue, discussing recent cases, policy proposals, and the broader implications for journalism, film, and entertainment. Whether you're an artist, a legal scholar, or simply someone fascinated by the intersection of technology and law, this episode offers an engaging and thought-provoking conversation.
