130. 一起讀判決：台灣人在泰國賣大麻被判有罪？

129. 毒駕條例修法｜Zoe：立法怠惰

128. 電鍋案：回收車上的物件都是「公物」
<p>本集講電鍋！影片版請見 YouTube：https://www.youtube.com/watch?v=dn5q3e7PhbM</p> <p>電鍋案簡介：2024年7月，被告的台北市北投區黃姓清潔隊員將回收車上的二手電鍋送給新北市新莊區的拾荒婦女，之後被隊內檢舉。而根據《臺北市政府環境保護局環境清潔勤務須知》回收物一旦上了回收車即為市府財物，又加上環保局清潔隊員為「類公務員」身份，所以檢察官依《貪污治罪條例》「侵占職務上持有之非公用私有財物」罪來起訴他。</p> <p>他被法官判有期徒刑三個月、緩刑兩年，褫奪公權一年。</p> <p>這件事情最近獲得社會高度關注。本集，Zoe 律師梳理案件的判決依據、常見疑問，也分享本案及法律實務上的盲點。</p> <p>其實，民眾是可以在回收車抵達之前撿走二手物品。物件一旦上車後就成為國家的財物，任何人都不能把它拿走。就算你要拿去做善事也不行。</p> <p>Zoe 解釋了業務侵占 vs 貪污的不同。以檢察官的觀點，被告利用職務上的機會擅自取走回收物，這就符合《貪污治罪條例》的規定。貪污罪的最輕本刑為五年以上，所以本案也不符合緩起訴。根據《刑事訴訟法》，緩起訴的適用範圍僅限於死刑、無期徒刑、或是最輕本刑3年以上的有期徒刑以外。</p> <p>法不近人情？：Zoe 說，其實法官已經在職責內將合理的減刑條件都套用了，法官動用了四次減刑，從原先最低量刑的五年減至三個月。減刑事由包括：</p> <ul> <li>一：被告自白＋繳回犯罪所得</li> <li>二：情節輕微＋犯罪所得低於5萬元</li> <li>三：自首</li> <li>四：《刑法》第59條 - 情堪憫恕、情輕法重</li> </ul> <p>本集錄音時間為12月5日，本集內容為參考及交叉比對近期的新聞報導。Zoe 坦言，在判決全文、起訴書尚未公布的情況下，她很納悶為何各大新聞都掌握許多細節。</p><p><a href="https://www.zeczec.com/projects/ghostislandme" rel="payment">捐款支持節目: https://www.zeczec.com/projects/ghostislandme</a></p><p>See <a href="https://omnystudio.com/listener">omnystudio.com/listener</a> for privacy information.</p>
