In het arrest staat de heffing van de erfbelasting centraal bij een verkrijging krachtens erfrecht door een niet-erkend kind van zijn biologische vader. Ondanks dat de Hoge Raad een ongerechtvaardigde discriminatie in de zin van art. 14 en 8 EVRM aanneemt, wordt geen rechtsherstel geboden aan het biologische niet-erkende kind. Volgens de Hoge Raad is de wetgever aan zet om in de Successiewet de discriminatie op te heffen van het kind dat family life heeft met zijn biologische vader die niet zijn juridische vader is.
