[…] Lucy Fernandez's death was not the result of unavoidable misfortune, but of criminally reckless conduct. She ended by asking the jury to return guilty verdicts on both charges. Once the state concluded its closing arguments, the burden shifted to the defense. For George Pino, that responsibility fell to veteran defense attorney Howard Strebnik, who rose to address the jury with a very different interpretation of the same evidence. He began by reminding jurors that the law requires proof beyond a reasonable doubt, not speculation, not emotion, and not hindsight. Srebnik told the jury that what had occurred on the water that night was a devastating accident, but it was not a crime. […]
