Remembering "Cake" Tunchanok Donhomla Part Two

In Part Two of our Remembering Tunchanok “Cake” Donhomla series, we move beyond the timeline and examine the legal framework that now shapes this case. This episode provides an in depth look at how Thailand’s criminal justice system operates, how it differs from the Australian legal system, and what international law may mean in cases involving foreign nationals. We explain the investigative process, criminal procedure, prosecution, sentencing principles, and the legal protections afforded to both victims and accused persons under Thai law. We also explore the legal instruments that provide the foundation for these proceedings, including the Thai Penal Code, the Thai Criminal Procedure Code, and the Constitution of the Kingdom of Thailand, while discussing how international obligations may intersect with domestic law through the Vienna Convention on Consular Relations, the United Nations Convention on the Rights of the Child (UNCRC), and guidance from the United Nations Office on Drugs and Crime (UNODC) regarding criminal justice and international cooperation. (UNODC (https://www.unodc.org/documents/treaties/UNCAC/CountryVisitFinalReports/2019_09_02_Thailand_Final_Country_Report.pdf?utm_source=chatgpt.com)) Rather than focusing on speculation, this episode explains what happens after an arrest, how evidence is assessed, the role of prosecutors and the courts, sentencing considerations, appeals, and what observers can realistically expect as legal proceedings continue. We also discuss the rights of victims, defendants, and foreign nationals throughout the process, highlighting both the similarities and important differences between Thai and Australian criminal justice systems. (UNODC (https://www.unodc.org/documents/treaties/UNCAC/CountryVisitFinalReports/2019_09_02_Thailand_Final_Country_Report.pdf?utm_source=chatgpt.com)) Our goal is to provide accurate legal context so listeners can better understand the process without misinformation or assumptions. As always, this episode is educational in nature and does not seek to determine guilt or innocence. Criminal responsibility can only be determined by the courts based on the evidence presented throughout the judicial process. References Constitution of the Kingdom of Thailand, B.E. 2560 (2017). Remembering “Cake” Tunchanok Part One

In Part One, we step away from the headlines to remember the person at the centre of this case. This episode explores who Tunchanok "Cake" Donhomla was, her life, the events leading up to her death, and the timeline as it is currently understood. We examine the known facts, separate verified information from speculation, and provide the context needed to understand how this tragedy unfolded. Our focus is on the victim and those who loved her. This episode does not examine the legal proceedings in detail. That discussion, including the investigation, evidence, court process, and the legal issues surrounding the case, will be covered in Part Two. As always, this episode is based on information available at the time of recording. Investigations and court proceedings can evolve as new evidence emerges, and criminal responsibility is determined by the courts, not by the media or podcasts. Content warning: This episode discusses homicide, death, family violence, and other themes that some listeners may find distressing. Listener discretion is advised. The Preventable Murder of Kobi Shepherdson

In this episode of Exhuming the Truth, we examine one of the most devastating coronial findings to emerge from Australia in recent years: the death of nine-month-old Kobi Shepherdson. Kobi was a baby who should still be here today. His death was found by a South Australian coroner to have been preventable. This is not simply the story of one dangerous offender. It is a case that exposes coercive control, escalating warning signs, and the devastating consequences when multiple systems fail to recognise and respond to the true level of risk. Together, we’ll work through the case chronologically, analyse the documented warning signs, and examine the findings delivered by Acting Deputy State Coroner Ian White in June 2026. As always, our focus is on understanding what happened, what was missed, and the lessons that may help prevent future tragedies. Content warning: This episode contains discussion of child death, domestic and family violence, coercive control, and other distressing themes that some listeners may find upsetting.
