The Dutch Franchise Act Episode with Manish Bahl

On 30 June 2020, the Dutch Parliament's upper house passed the Dutch Franchise Act ("DFA"). The DFA is due to enter into force in January 2021, and it means that the Netherlands now joins a number of other European countries to have a franchise-specific law.

In the podcast, Gordon Drakes (co-head of Fieldfisher's franchising team) discusses the DFA with Manish Bahl, a partner at the firm's Amsterdam office who specialises in commercial and competition law. Their discussion covers the popularity of the franchise model in the Netherlands, the reasons behind the genesis of the DFA and the key areas to note in the new legislation. As an important European economy which is seen increasingly as a favourable location for international businesses, it is important that businesses understand the reach of the new DFA.

Please also click here to read Manish's article on this subject - https://www.fieldfisher.com/en/services/franchising/franchise-commercial-law-blog/update-dutch-franchise-act

If you would like to know more about this topic, please contact Gordon Drakes (Gordon.Drakes@fieldfisher.com) or Manish Bahl (Manish.Bahl@fieldfisher.com).

Franchising 101 – How to prepare your business for franchising

In the wake of the Covid-19 pandemic, the franchise model will have an important role to play in the economic recovery, helping individuals take their first steps into business ownership, presenting opportunities to established operators to grow their portfolios and enabling brand owners to expand and regain and/or grow market share. What other options are there?

Once a business has decided on the franchise route, what are the first things it should consider?

What legal documents are typically used within a franchise, and what is their purpose?

What are the key terms of a franchise agreement?

What are the main risks for a would-be franchisor?

How can a business ensure the franchise is a success?

You can read more on this topic at the Fieldfisher website by clicking here
