[…] So the defense attorney, Richard Lustig, who was working pro bono for Kentsu, filed a petition and it raised several constitutional procedural issues he contended had occurred during the trial. In addition to claiming ineffective assistance of trial and appellate counsel, he alleged prosecutorial misconduct, stating that for the court to even allow Cleland to present the phantom plane theory was unconscionable. Now, they also have the altered lineup photographs that was raised. And Kentsu's team claimed that the relevant information had not been shared with defense counsel at the trial. There's also concerns including actual innocence, which is supported, they say, by new alibi evidence. […]
