<p>In dieser Folge «Freispruch» bespricht Boris Etter, Fachanwalt SAV Strafrecht, dieBedeutung des Smartphones im Strafrecht. Heutige Smartphones sammeln personenbezogene Daten aller Art, von Chatverläufen, Fotos und Videos bis hin zu Schritten und weiteren Gesundheitsdaten. Dementsprechend können die auf dem Smartphone befindlichen Daten im Strafverfahren belastend, entlastend oder ein reiner Zufallsfund sein. Es wird anhand vieler Praxisbeispiele und aktueller bundesgerichtlicher Rechtsprechung aufgezeigt, wie mit Smartphones im Strafverfahren umgegangen wird und insbesondere welche bedeutende Rolle die Siegelung (Art. 248 StPO) dabei spielen kann.</p><p>Viel Spass beim Zuhören!</p>

<p>In dieser Folge Freispruch bespricht Boris Etter, Fachanwalt SAV Strafrecht, anhand der Hauptverhandlung des Urteils GG 250 130 des Bezirksgerichts Zürich vom 28. Januar 2026 (nicht rechtskräftig, es gilt selbstverständlich gegenüber Sanija Ameti die Unschuldsvermutung) den Tatbestand von Art. 261 StGB «Störung der Glaubens- und Kultusfreiheit». Diejenigen Massenmedien, welche echte Gerichtsberichterstattung betrieben haben (andere haben den Prozess für politische Propaganda benutzt), übersahen mehrheitlich spannende rechtliche Fragestellungen.</p><p>Viel Spass beim Zuhören!</p><p></p>

<p>In dieser Folge «Freispruch» von Boris Etter, Fachanwalt SAV Strafrecht wird, zumersten Mal mit neuer Moderation, das Thema der Untersuchungshaft besprochen. Die Untersuchungshaft sowie die Voraussetzungen, die zu ihrer Anordnung erfüllt sein müssen, werden anhand des aktuellen Falls Crans-Montana besprochen. Ein Augenmerk wird dabei insbesondere auf die Fluchtgefahr gelegt. Zudem werden Ersatzmassnahmen wie die Schriftensperre und das Electronic Monitoring besprochen.</p><p>Viel Spass beim Zuhören!</p>
