Unlike under the UPCPA, under 1949-01, the filing of the post-conviction in these capital cases precedes a direct appeal. And as the court well knows, in every other type of criminal case, that's not the case. A defendant will have the opportunity to conduct their appeal immediately after judgment and conviction. They file that notice of appeal. They go through that appellate process. And then only after the resolution of the appeal do the timelines, the one-year statutory timeline, kick in under 1949-02.
