<p>Today we look at the case of MILFORD MAAMBO AND TWO OTHERS V THE PEOPLE, a 2017 where we see the defense Counsel rejecting the entry of the Nolle Prosequi by the Prosecution on behalf of the Director of Public Prosecutions arguing that it was unlawful and lacking procedure as DPP did not disclose reasons for entry of NOLLE prosequi. Defense Counsel put up a spirited argument urging the presiding Judge to order disclosure of the DPP’s reasons to enter NOLLE prosequi, or to refer the matter to the Constitutional Court for the determination of the Constitutional issue that had arisen. <br/>Listen in and let’s learn together.</p>
