   Episode 19: Dukes. Counts, Charters and Kings - French Law in the High Middle Ages

   What did “the law” mean in a kingdom where crossing a river could change the toll, the court, the custom, and even the way a dispute was proved? In medieval France, there was no single national code waiting on a shelf. Justice lived in local memory, feudal obligation, sacred ritual, church doctrine, written privilege, and the authority of whoever had the power to summon a court. In this episode of Historia Juris, we travel through France between 1000 and 1250 to explore how that fragmented legal world slowly became more written, more professional, and more closely connected to royal power. Along the way, we encounter oath-helpers, ordeals, judicial combat, feudal courts, church tribunals, town charters, Roman legal texts, and the emerging class of trained jurists who began to treat law as a discipline that could be collected, interpreted, taught, and administered. We also follow the expanding ambitions of the Capetian monarchy. As royal officers traveled farther, records multiplied, and litigants looked beyond local lords for justice, the king increasingly claimed the right not merely to rule, but to judge the judges. Yet centralization did not erase local custom. Towns, churches, nobles, and rural communities continued to defend their own privileges, often using the new language of charters, appeals, and learned law to do so. How did custom survive even as the crown grew stronger? Why did the church’s withdrawal from ordeals transform legal proof? And how did Roman and canon law help turn a patchwork of courts into the beginnings of a wider legal order? Join us for a journey into the centuries when law became more than a local inheritance: it became a written record, a learned profession, and a powerful instrument of government—laying foundations that still support the legal traditions of continental Europe.    Episode 18: Glossators, Communes, Bishops and Notaries - Italian Law in the High Middle Ages

   Between 950 and 1250, Italy was not one country—and it certainly did not have one law. Roman doctrine, Lombard and Frankish custom, canon law, feudal rules, city statutes, and royal commands all competed for authority. The answer to “what is the law?” often depended on who you were, where you stood, and which court could make its judgment stick. In this episode, we enter that crowded legal world: Henry IV crosses the snowy Alps for his dramatic confrontation with Pope Gregory VII at Canossa; Bologna’s scholars turn ancient Roman texts into powerful new tools of legal reasoning; self-governing communes battle emperors for control of their courts and customs; and Norman rulers build a strikingly centralized kingdom in southern Italy and Sicily. Along the way, we meet the glossators, canonists, notaries, bishops, merchants, vassals, and magistrates who made this jumble of jurisdictions work. Italy did not give medieval Europe a single legal code. It gave it something more adaptable—a shared legal language capable of crossing borders, managing conflict, and shaping European law for centuries.    Episode 17: From the Umayyads to the Ottomans - Islamic Law in the High Middle Ages

   How did Islamic law govern a vast medieval world of competing empires, legal schools, and religious communities? This episode explores the judges, scholars, courts, and rulers who shaped Islamic legal traditions between the year 1000 and the fall of Constantinople in 1453. Along the way, we examine the work of qadis and muftis, the rise of the major Sunni schools, the place of Shi’a jurisprudence, the legal autonomy of Jewish and Christian communities, and the impact of the Crusades and Mongol conquests. It is a story of remarkable diversity, political tension, and a legal system resilient enough to survive the rise and fall of empires.
