E42: I fought the law...and I drew the tower
What happens when a nearly 160-year-old fortune-telling law collides with modern Paganism, tarot, religious freedom, and the First Amendment?
In this episode of I Am Heathen (And So Can You!), Einar heads to Hanover, Pennsylvania, to examine the legal battle surrounding Beck Ravenswood (Rios), owner of The Serpent's Key Shoppe and Sanctuary, and Pennsylvania's controversial fortune-telling statute, 18 Pa. C.S. § 7104.
After Hanover police raised concerns about paid tarot readings under Pennsylvania law, Beck fought back, launching a federal constitutional challenge in Rios v. Martin. But this story goes far beyond one Pagan shop and one Pennsylvania statute.
We dig into the rise of nineteenth-century Spiritualism, the Fox sisters and the very real history of fraudulent mediumship; ask whether modern fraud and consumer-protection laws make statutes specifically targeting fortune telling obsolete; examine the dangerous little word “pretends”; and explore the uncomfortable question sitting underneath the entire case:
Should the government ever be responsible for deciding whether somebody else's spiritual beliefs are real?
