Adel getadelt
Mit der Gründung der Republik ist seit 1919 der Adel in Österreich aufgehoben. Vorrechte auf Basis der Geburt in eine adelige Familie bestehen nicht mehr. Es ist auch verboten, Adelstitel oder ähnliche Bezeichnungen, die solche Vorrechte suggerieren, zu führen. Im heute besprochenen aktuellen Erkenntnis des Verwaltungsgerichtshofes beantragte eine österreichisch-französische Doppelstaatsbürgerin die Führung des französischen "de" ("von") im Namen. In letzter Instanz entschied nun der VwGH, dass dies nicht zulässig ist und die zuständige Behörde ihren Antrag richtigerweise ablehnte.

Das Freiheit beschränkende Virus
Die COVID-19-Pandemie kann es notwendig machen, auch starke Beschränkungen der persönlichen Freiheit zuzulassen. Nach einem aktuellen Beschluss des Obersten Gerichtshofes kann es auch zulässig sein, Bewohner_innen von Alten- oder Pflegeheimen in Einzelisolierung zu zwingen, auch wenn diese einen negativen COVID-19-Test vorweisen können. In dieser Entscheidung des OGH war das zulässig, weil das Risiko im betroffenen Heim besonders hoch war und der Betroffene schwer dement war. Gelindere Mittel wie das Tragen eines Mund-Nasen-Schutzes oder Einhaltung von Abstand waren daher bei diesem Betroffenen nicht möglich. Die Entscheidung macht die persönlichen Schicksale besonders verletzlicher Personen(gruppen) in dieser Pandemie deutlich.

Verschleierter Hooligan
Das Anti-Gesichtsverhüllungsgesetz wurde 2017 in Kraft gesetzt und soll seitdem "Integration fördern". Es zielt dabei auf manche Arten der islamischen Verschleierung für Frauen ab und verbietet diese. Ein aktuelles Erkenntnis des Verwaltungsgerichtshofes zeigt jedoch, dass das Gesetz noch viel weiter und sehr allgemein ausgelegt werden muss. Wir besprechen das Erkenntnis und die Hintergründe des Anti-Gesichtsverhüllungsgesetzes kritisch.
