[…] His wife is also an attorney, we think. And so he basically stands on his Fourth Amendment rights. and says, you know, we're not going to do any more of this. I am going into my home. So he tries to go into the home. Police stop him from closing the door and force their way in, after which they do some investigation and conclude that, indeed, there was no kidnapping. So Mr. Hyatt sues under Section 1983. Arguing that the police officers violated his Fourth Amendment rights. The district courts grants the officers motion to dismiss, holding that they had reasonable suspicion to act on this potential kidnapping and that otherwise acted properly within the bounds of the Fourth Amendment.
