<p>In dieser besonderen J!Cast Folge hören Sie einen besonders interessanten Vortrag. Am 17.01.2024 hielt Herr Rechtsanwalt Dr. Malte Frank (Hengeler) vor 60 Zuhörern einen fulminanten Vortrag über kartellrechtliche Probleme bei Sportübertragungsrechten. Er hat es geschafft, seine exzellente 1000-seitige Doktorarbeit zu diesem Thema in 45 Minuten überzeugend vorzustellen. Die Präsentation stieß auf ein hervorragendes Echo nicht nur bei den Zuhörern des ITM, sondern auch bei YouTube.</p> <p><br></p>

<p>In dieser neuen Folge des ITM-Podcasts besprechen die beiden wissenschaftlichen Mitarbeiter Owen Mc Grath und Klaus Palenberg das EuGH-Urteil zur Klagebefugnis von Verbraucherverbänden für Datenschutzverstöße. Kern der Besprechung ist die Entscheidung des EuGH, dass sich auch nach Einführung der DSGVO Verbraucherverbände auf die Befugnisnormen nach §§ 8 Abs. 3 UWG, 3 Abs. 1 S. 1 Nr. 1 UKlaG stützen können, um Datenschutzverstöße zu verfolgen. Dabei können sie auch auf eigene Initiative hin tätig werden und bedürfen keines unmittelbaren Auftrags.</p> <p>Das Urteil des EuGH zum Nachlesen: <a href="https://curia.europa.eu/juris/document/document.jsf?text=&docid=258485&pageIndex=0&doclang=de&mode=req&dir=&occ=first&part=1&cid=643441" target="_blank">EuGH-Urteil vom 28.04.2022, C-319/20</a>.</p>

<p>In dieser kurzen Folge des ITM-Podcasts sprechen die wissenschaftlichen Mitarbeiter Malin Fischer, Owen Mc Grath und Nicolas John über das geplante Trans-Atlantic Data Privacy Framework. Die EU-Kommission und die US-Regierung haben sich vor kurzem über die Grundlagen eines solchen neuen Datenschutzrahmens geeinigt. Mit diesem sollen Datentransfers aus EU-Ländern in die USA in Zukunft rechtssicher möglich sein. Das bisherige Abkommen, das EU-US-Privacy-Shield, hatte der Europäische Gerichtshof in einem Urteil aus 2020 für unzureichend erklärt.</p> <p>Zu der Thematik liegt bereits eine <a href="https://www.orca.nrw/sites/default/files/dokumente/RiDHnrw_11-04-22_Kurzmitteilung_neuer_transatlantischer_Datenschutzrahmen.pdf" target="_blank">Kurzmitteilung der RiDH</a> vor und im Mai erscheint außerdem ein Beitrag im <a href="https://www.itm.nrw/wp-content/uploads/Infobrief_Recht_5-2022.pdf#page=10" target="_blank">Infobrief-Recht des DFN</a>.</p>
