Das Gericht prüft, ob die Bestimmungen des WHG, die den <strong>Zugang zu und die Nutzung von Grundwasser von einer behördlichen Genehmigung abhängig machen</strong>, eine verfassungswidrige Enteignung von Grundeigentümern darstellen. Der Fall ergibt sich aus der Klage eines Kiesbaggereiunternehmers, dem eine Erlaubnis zur Grundwassernutzung versagt wurde und der eine Entschädigung für die dadurch entstandenen wirtschaftlichen Nachteile fordert. Die Debatte konzentriert sich darauf, ob das WHG den Inhalt und die Schranken des Eigentums im Sinne von Artikel 14 Absatz 1 Satz 2 GG rechtmäßig bestimmt oder ob es sich um eine entschädigungspflichtige Enteignung nach Artikel 14 Absatz 3 GG handelt.</p>

Mephisto Urteil
<p>BVerfG vom 24.02.1971 - 1 BvR 435/68</p><p><strong>Bundesverfassungsgerichtsurteil zum "Mephisto"-Roman</strong>. Es geht um die Frage, ob die <strong>Kunstfreiheit (Artikel 5 Absatz 3 Grundgesetz)</strong> durch die <strong>Persönlichkeitsrechte (Artikel 1 Absatz 1 Grundgesetz)</strong> des verstorbenen Schauspielers Gustaf Gründgens eingeschränkt werden kann. Das Gericht musste abwägen, ob die Darstellung Gründgens im Roman dessen Menschenwürde verletzt, obwohl der Roman als Kunstwerk anerkannt wurde. Das Urteil stellte fest, dass ein Konflikt nach der grundgesetzlichen Wertordnung gelöst werden muss, wobei die Menschenwürde besonders zu beachten ist. Die Verfassungsbeschwerde wurde jedoch zurückgewiesen, da die angefochtenen Urteile die Abwägungsgrundsätze nicht grundsätzlich falsch angewendet hätten.</p>

Das Gericht bestätigt, dass die Rechtsprechung der Zivilgerichte, die eine solche Entschädigung bei schweren Verletzungen des allgemeinen Persönlichkeitsrechts vorsieht, <strong>mit dem Grundgesetz vereinbar</strong> ist. Es wird betont, dass das <strong>allgemeine Persönlichkeitsrecht</strong>, das aus den Art. 1 und 2 des Grundgesetzes abgeleitet wird, ein "allgemeines Gesetz" im Sinne von Art. 5 Abs. 2 GG ist und somit die <strong>Pressefreiheit einschränken</strong> kann, wobei eine <strong>Abwägung der Interessen</strong> notwendig ist.
