Lawyer & Layman Explain It has returned…for now! Martin and Kasey are bringing you a very special episode about the monumental (and possibly best named) Supreme Court case, Loving v. Virginia–just in time for Loving Day, observed on June 12. This case struck down bans against interracial marriage that existed in many states at the time. Listen to hear your hosts talk about a love story incredible in large part because of its normalcy, and learn about ways that you can celebrate Loving Day (maybe by getting the day officially recognized by your city or county; trust us, it’s not as hard as it sounds!). If you are a first time listener and want to learn more about gerrymandering, the Voting Rights Act, or the Warren Supreme Court, check out Episodes 1, 2, and 7!
Also, for the Constitutional Law nerds out there: Martin references the 4th Amendment a few times in this episode and while it is often cited as the constitutional protection of privacy and was the basis of some other cases Martin referred to, in Loving V. Virginia, the Supreme Court made its decision based on the 14th Amendment. Kasey’s been out of law school for a while, doesn’t practice in court anymore, and is exhausted keeping up with their 6 month old! Sorry for the mix up, ya’ll!

The Judge That Said: “Nahh.”
Kasey and Martin are back, after a bit of an unplanned hiatus! Your hosts switch gears slightly to bring the focus on a lower federal court: specifically, the District of Rhode Island, where Chief Judge John J. McConnell Jr. said “nah” to executive actions that resulted in a freeze of federal funds that should be going to states. Chief Judge McConnell also said “yes” to basic civics education, given the apparent lack of awareness about how the three branches of government work. Kasey also explains some legal terminology that you might be seeing in the news and wondering, “what does that mean”? If you are looking for some good news during these times, this episode might leave you feeling a little more encouraged.

Roberts n Them: The Modern Supreme Court (Part 2)
Martin and Kasey are back with more on the modern Supreme Court! In between Kasey expressing her disappointment with Martin not knowing who K.P. & Envyi are, the hosts discuss the importance of the swing vote on the Court, and why we should be worried about the fact that there really isn’t a swing voter anymore (at least, not in the way there used to be) among the 9 justices. They also talk about the Supreme Court’s very weak Code of Conduct, and what it might look like if there was a way to actually enforce the requirement to “not allow family, social, political, financial, or other relationships to influence official conduct or judgment.” Of course, we want the backgrounds of the justices to inform their opinions in some cases—but we want more of the human element and less of the political and financial ones.

Roberts n Them: The Modern Supreme Court (Part 1)
After providing listeners with some basic facts about the Supreme Court, and walking through the Court’s history, Kasey and Martin have finally arrived at the modern Court era! In this episode, the hosts discuss the changes that have occurred since 2005, when Chief Justice Roberts joined the Court. In that year, tall tees and Baby Phat reigned supreme (ba doom cha), The Wire was on a hiatus, and the U.S. was embroiled in (at least) two major wars. It was also the beginning of the Supreme Court’s extreme shift to the right that operates to the detriment of all of us in the United States.
Today’s discussion also explores the clear connection between the Rehnquist Court and the Roberts Court.

Supreme Court 101 (Part 2)
Have you ever read a Supreme Court opinion? Odds are, if you’re not a lawyer or in a law-adjacent field, you haven’t. And we don’t blame you—those things are long and BORING!! But, they also shape most (if not all) aspects of our lives. Who we go to school with, who we can marry, which of our activities can be monitored…those facets are all governed by Supreme Court case law, along with so many more. So, we should know how to read one of these massive documents, or at least know where to find them!

Supreme Court 101 (Part 1)
Do you know why it’s called the “Supreme” Court? Do you know where the Court is physically located? Do you know the two categories of cases the Supreme Court can hear? If ya don’t know, now ya know (at least after listening to this episode!). Martin and Kasey will explain some of the U.S. Supreme Court basics over the course of two episodes. Note that these episodes are NOT about the history of the Supreme Court, or the modern Court…those are topics for the next few episodes! Happy 59th birthday, Voting Rights Act!
The Voting Rights Act has been called one of the most successful pieces of civil rights legislation. In this episode, we’re talking about the law that cemented the Fifteenth Amendment and gave Black Americans the right to vote. We’ll also be talking about two Supreme Court cases that have eroded this important law, and what that means for all of us in the United States today, especially as we approach the 2024 presidential election. Kasey spends a little more time describing the Shelby County case that we introduced in the first episode. Toward the end of the episode, we’ll share some suggestions for listeners that are feeling fired up and looking for ways to take action.

Why a 19th century governor and an amphibian are so important
Welcome to the pod! In our very first episode, we’re discussing why Governor Elbridge Gerry and an amphibian are so important. That’s right, we’re talking about gerrymandering: where did the term come from, what does it mean, and how does it impact us today? We’ll explain how a guy named Elbridge Gerry caved to peer pressure and started it all. We’ll also talk about two big Supreme Court cases that have made it much harder to combat race-based gerrymandering. Note for listeners: there are two competing stories about how the term “gerrymandering” was coined. We decided to feature the one that some sources have called more credible (and TBH, it’s also more fun). Do your own research on this though! A second note for listeners: after recording, Kasey realized that her explanation of the Shelby County Supreme Court case wasn’t the clearest (this is her first time podcasting–she’s still figuring it out). But fear not: in our second episode, we’ll be offering more clarity and detail about the case!
