We’re Back, Celebrating the Importance of Loving
<p>***Please note this episode contains sensitive language (antiquated racial slur) - listener discretion is advised***</p><p>Lawyer & Layman Explain It has returned…for now! Martin and Kasey are bringing you a very special episode about the monumental (and possibly best named) Supreme Court case, Loving v. Virginia–just in time for Loving Day, observed on June 12. This case struck down bans against interracial marriage that existed in many states at the time. Listen to hear your hosts talk about a love story incredible in large part because of its normalcy, and learn about ways that you can celebrate Loving Day (maybe by getting the day officially recognized by your city or county; trust us, it’s not as hard as it sounds!). If you are a first time listener and want to learn more about gerrymandering, the Voting Rights Act, or the Warren Supreme Court, check out Episodes 1, 2, and 7!</p><p><br></p><p>Also, for the Constitutional Law nerds out there: Martin references the 4th Amendment a few times in this episode and while it is often cited as the constitutional protection of privacy and was the basis of some other cases Martin referred to, in Loving V. Virginia, the Supreme Court made its decision based on the 14th Amendment. Kasey’s been out of law school for a while, doesn’t practice in court anymore, and is exhausted keeping up with their 6 month old! The Judge That Said: “Nahh.”
<p></p><p>Kasey and Martin are back, after a bit of an unplanned hiatus! Your hosts switch gears slightly to bring the focus on a lower federal court: specifically, the District of Rhode Island, where Chief Judge John J. McConnell Jr. said “nah” to executive actions that resulted in a freeze of federal funds that should be going to states. Chief Judge McConnell also said “yes” to basic civics education, given the apparent lack of awareness about how the three branches of government work. Kasey also explains some legal terminology that you might be seeing in the news and wondering, “what does that mean”? Roberts n Them: The Modern Supreme Court (Part 2)
<p>Martin and Kasey are back with more on the modern Supreme Court! In between Kasey expressing her disappointment with Martin not knowing who K.P. & Envyi are, the hosts discuss the importance of the swing vote on the Court, and why we should be worried about the fact that there really isn’t a swing voter anymore (at least, not in the way there used to be) among the 9 justices.
