[…] In any case, there was only a single ground of appeal, and that was that the judge had failed to properly determine whether or not the applicant's moral culpability was reduced because of that disadvantaged background resulting in a miscarriage. And that was upheld ultimately. The interesting passages I found were at paragraph 28, where His Honour said this, the idea of a causal link between a background such as the applicant's and his offending is problematic. Humans are more complicated than such a formulation allows. The idea that the applicant's life experience from the age of six or seven did not shape him such as to have an impact on who he became and consequently his behaviours is problematic. […]
