Computer-implemented simulation at the EPO: G 1/19 in a nutshell
Decision G 1/19 (https://documents.epo.org/projects/babylon/eponet.nsf/0/99f4b971c9e3eb2fc125869400340179/$FILE/G_1_19_decision_of_the_Enlarged_Board_of_Appeal_of_10_March_2021_en.pdf) of the Enlarged Board of Appeal has been published on 10 March 2021. The decision is not only of relevance for computer-implemented simulations, but rather for all kinds of mixed inventions. G 1/19 carves the COMVIK approach (T 641/00 (https://www.epo.org/law-practice/case-law-appeals/pdf/t000641ex1.pdf)) in stone - and stops short of saying that the former lead case in the field of computer-implemented simulation, T 1227/05 (https://www.epo.org/law-practice/case-law-appeals/pdf/t051227ep1.pdf) (Infineon), came to the wrong conclusion.
