Trial Lawyers Association, is a countywide organization of comprised of more than 400 trial attorneys and more than 100 paralegals that represent the plaintiff in civil cases. It has grown to be the most dynamic countywide trial lawyer organization in the state. The Palm Beach County Justice Association was established in 1988 by a small group of Palm Beach County trial lawyers for the purpose of networking and the mutual sharing of knowledge. United in their dedication to representing the injured party in civil cases, the association organized occasional programs and seminars for the education and professional development of its members. Since our founding, the PBCJA has been dedicated to upholding the honor and dignity of the legal profession. Our members are steadfast in their efforts to vigorously represent ALL injured parties, regardless of their race, religion, gender, sexual orientation, status, disability or differences, with the utmost professionalism. Florida Appellate Review- Episode 6
Welcome to another edition of the Florida Appellate Review Case Law Update. In this week’s episode, Palm Beach County Justice Association Board Member and Podcast Host Andrew Harris, and fellow Board Members, Jennifer Dinetz and Jeff Adelman, discussed a series of cases addressing:
Whether insurance adjusters and a medical doctor’s affidavits were properly stricken by the trial judge, where the affidavits addressed the reasonableness of medical costs and whether medical treatment was reasonably related to the subject motor vehicle accidents;
Whether an adverse inference instruction was warranted in an Engle progeny case where a plaintiff shredded medical records, including the circumstances in which a duty to preserve evidence arises, and whether a duty to preserve evidence is required before an adverse inference instruction is given by a trial judge; and
Whether a hotel was entitled to summary judgment in a negligence case where an invitee fell in an unbeveled 3/8 inch change in evaluation between the tiled entryway and the carpeted floor of the hotel room.

•A $10 million dollar plaintiff’s verdict reversed due to a series of improper closing arguments by a trial attorney who was criticized out yet again by the Fourth District Court of Appeal for improper closing arguments in Engle progeny cases;
•The distribution of attorneys’ fees between partners in a contingency case when one partner leaves the Firm, where there is partnership agreement addressing fees ; and
•Whether Proposals for Settlement and other documents served (but not filed) must comply with the electronic service requirements for court-filed documents.

Florida Appellate Review - Episode 4
Welcome to another edition of the Florida Appellate Review Case Law Update. In this week’s episode (July 13, 2021), Palm Beach County Justice Association Board Members Andrew Harris and Jennifer Dinetz discussed a trio of cases addressing:
•An Engle progeny case where an attorney’s improper closing argument resulted in a new trial;
•The “boarding” of past medical bills for a plaintiff who is a Medicare recipient, with the Fourth District certifying a question of great public importance to the Florida Supreme Court; and
•An appellate court’s referral of an attorney to the Florida Bar after the attorney engaged in improper conduct towards the opposing party and opposing counsel in trial proceedings.

•Whether a tortfeasor can claim set-off of a plaintiff’s settlement with an uninsured motorist carrier, with the Second District Court of Appeal certifying a question of great public importance to the Florida Supreme Court;
•Whether a tortfeasor is entitled to financial discovery of a plaintiff’s attorney’s financial relationship to a retained expert; and
•Whether a party was entitled to vacate a default judgment.

Welcome to the debut of the Florida Appellate Review with PBCJA Board Members Andrew Harris, Jen Dinetz, and Jeff Adelman. The Appellate Review will regularly provide updates on cases relevant to your civil practices, with an emphasis on personal-injury and tort-related cases.
In this week’s episode, Andrew, Jen and Jeff discuss: whether the untimely disclosure of surveillance video warrants a new trial, whether two mentions that the plaintiff had insurance requires a new trial, the implications of a trial judge’s Daubert ruling excluding an expert opinion on causation, and an insurance bad-faith case.
