Ep. 52 From Privacy Risk to Owner Control: What CRE Owners Need to Know About Building Data
In this episode of Peak Property Performance, Bill Douglas and Drew Hall speak with Derek Neathery, Partner at Quarles & Brady LLP, about a growing risk in commercial real estate: who actually controls the data generated by a building. They explore vendor agreements, data privacy, digital infrastructure, and what owners should understand before signing away rights that may affect operations and asset value. Building data ownership and privacy CRE vendor agreements Property management technology Data collection and retention Vendor-controlled infrastructure Telecom and connectivity agreements Digital due diligence Protecting long-term asset value Derek: Everything automated within a building produces data. Software providers, property managers, and consultants may all touch it, and their contracts can grant broad rights to store, aggregate, use, or even monetize that information. Derek: An owner may technically own building data while a vendor's contract gives that vendor broad rights to use it. Owners need to understand what is collected, who can access it, how it can be used, and whether those rights continue indefinitely. Electronic locks and other connected systems improve operations but also generate information about how people use a property. The contract determines where that data goes, who can use it, and who carries responsibility if it is compromised. Telecom providers may offer to wire a property at no upfront cost, but agreements can last ten years, restrict competing providers, and give the vendor significant control over infrastructure inside the building. Those restrictions can even become an issue during a future sale. Derek: Network planning should happen alongside the physical design of a property—not after construction decisions have already been made. When owners know what they want upfront, legal counsel can negotiate contracts around a clear business strategy. Bill: Owners should ask every vendor what happens if the relationship ends. Do you keep the sensors, handsets, network, wiring, and data? And if you own the data, what rights does the vendor retain? Digital infrastructure and data rights are often overlooked during property acquisitions. Derek expects this to change as the industry develops standards, much like environmental diligence eventually became routine in real estate transactions. Owners should understand: What data is collected? Who owns it? Who can use it? How is it secured? Who is responsible after a breach? And what happens to the data when the relationship ends? Best career advice? You get the clients you deserve—your behavior influences the people you attract. Habit that makes you effective? Do one thing at a time and finish it before moving on. Ep. 51 What CRE Gets Wrong About Technology and Innovation
In Episode 51 of Peak Property Performance, Bill Douglas and Drew Hall speak with Ryan Elazari, commercial real estate operator, innovation leader, educator, and host of CRE Unplugged. Ryan shares lessons from both sides of CRE innovation, exploring why technology fails, what owners should demand from vendors, and why successful adoption starts with understanding real operational problems. CRE technology and innovation PropTech adoption Technology ROI Vendor evaluation Change management Technology roadmaps AI in commercial real estate CRE education and networking Drew: What does CRE need to understand about innovation? Ryan: Go back to the basics. Owners want to lower expenses and increase NOI. Technology companies need to clearly demonstrate how their solution accomplishes those goals rather than simply selling a product. Ryan: Vendors should understand how a property actually operates. Inspect the building, identify its problems, and demonstrate the ROI and payback period. A product demo means little without understanding the customer's needs. Bill: Who owns technology adoption inside a CRE organization? Ryan: Implementation requires training, communication, and hands-on support for the people who actually use the technology. You can't install a solution and expect it to magically work, especially when teams are resistant to change. Ryan: We implemented a boiler management system that employees eventually bypassed because it was frustrating to use and lacked sufficient support. Despite significant investment, the property manager ultimately pulled the plug. Great sales don't guarantee successful adoption. Ryan: Owners shouldn't automatically adopt a technology because a large institution uses it or a trusted management company recommends it. Research solutions, talk with other operators, understand potential conflicts, and ask hard questions before making a decision. Ryan: Don't expect to walk into a conference and magically find the right solution. Identify your pain points beforehand, prepare questions, research vendors, and schedule relevant meetings in advance. Ryan: PropTech companies that failed to adapt to AI are losing ground to competitors that did. But the next generation of CRE professionals also needs stronger education around AI, PropTech, and how buildings actually operate. Ryan: Technology companies facing long sales cycles need to build long-term relationships and trust. The same lesson applies to careers: your professional network can help create opportunities that technology alone cannot. Drew: Best career or life advice? Ryan: Never give up. Believe in what you're doing and don't let rejection discourage you. Bill: Habit that makes you more effective? Ryan: Working out, running, tennis, or basketball helps me get into the right mindset. Drew: Early bird or night owl? Ryan: Night owl. I've always been that way.
