[…] But really, the reason why retainage is withheld is to limit the owner's liability, right? And how that works is, okay, so say you have a million dollar contract, right? And then the retainage is $100,000, right? 10%. So that $100,000 is retained until final completion. The idea is that the owner's liability to lien claimants will be capped at that $100,000 or that 10% if he properly withholds the 10%. So what that looks like is say on the job, the owner withheld 10%, it's 100 grand, but he's got $150,000 in liens, right? So the owner's liability will be the 100 grand and then the lien claimants will have to share that 100 grand based pro rata. […]
