AI Transparency in Practice
Since August 2026, Article 50 of the EU AI Act has required businesses to tell people when they are interacting with AI or viewing certain AI-generated content. Skadden counsel Jonathan Stephenson (https://www.skadden.com/professionals/s/stephenson-jonathan) and Elva Cullen (https://www.skadden.com/professionals/c/cullen-elva-m) join host Deborah Kirk (https://www.skadden.com/professionals/k/kirk-deborah-j) to discuss what compliance looks like in practice. Elva distinguishes AI providers from deployers, while Jonathan notes that a generic line in the terms and conditions is unlikely to suffice. He also discusses the European Commission's voluntary Code of Practice on Transparency and AI-Generated Content, which offers businesses a recognized route to meeting the Article 50 requirements. Looking ahead, existing generative AI systems face a December 2026 marking deadline, and Deborah walks through the high-risk deadlines, now set for December 2027 and August 2028, and how the extra time can serve as a runway for preparation. The conversation then widens to the U.S., where a voluntary pledge with no enforcement mechanisms contrasts with the EU's binding framework. BYTES: Emotional Perception and AI Patents
A landmark UK Supreme Court ruling could change how AI businesses protect their innovations. In this episode of "Bytes," Skadden's Maximilian Willis (https://www.skadden.com/professionals/w/willis-maximilian-g) breaks down the Emotional Perception AI decision and its implications. The case centered on whether an artificial neural network, designed to recommend music based on emotional similarity to other music assessed through both semantic and musical properties of the music concerned, was excluded from patentability as a "computer program as such." The Supreme Court moved away from the longstanding Aerotel test, adopting the European Patent Office's "any hardware" approach. Because the ANN ran on a computer, it cleared the initial patentability hurdle, though the case returns to the UK IPO for further consideration. For AI businesses, the ruling raises an important question — could their systems now qualify for formal patent protection? Silicon & Strategy: Breaking Down the June 2026 EU Tech Sovereignty Package
Europe has spent a decade writing the rulebook on technology. Now it wants to build the stack. In this episode of “SkadBytes,” Jonathan Stephenson (https://www.skadden.com/professionals/s/stephenson-jonathan) and Alistair Ho (https://www.skadden.com/professionals/h/ho-alistair), attorneys from Skadden's IP and technology team in London, break down the EU's newly unveiled European technological sovereignty package, a four-part digital plan encompassing the Cloud and AI Development Act (CADA) and Chips Act 2.0. Jonathan and Alistair explore CADA's plan to triple EU data center capacity by 2035, the tiered sovereignty requirements for cloud providers, and what the framework means for U.S. and UK-based businesses. They also compare Europe's approach with the U.K.'s commercially minded Sovereign AI Fund — and what both mean for investment opportunity. Bytes: Classifying High-Risk AI Under the EU AI Act
The European Commission has published draft guidelines to help businesses navigate one of the EU AI Act's most consequential determinations: whether their AI systems fall into the high-risk category. In this episode of “Bytes,” Emily Griffin from Skadden's IP and Technology team in London breaks down the two routes to a high-risk classification under Article 6: the product safety route, covering AI systems that are regulated products or safety components subject to third-party conformity assessment, and the use-case route, covering systems whose intended purpose falls into one of eight sensitive areas. She also highlights a self-assessment “safety valve” under Article 6(3) and updated compliance timelines, with a clear message: start the classification work now. Connect and Learn More ☑️ Emily L. AI Regulation: EU and UK Update and What It Means in Practice
Skadden (https://www.skadden.com/) attorneys Jonathan Stephenson (https://www.skadden.com/professionals/s/stephenson-jonathan) and Alistair Ho (https://www.skadden.com/professionals/h/ho-alistair) join host Deborah Kirk (https://www.skadden.com/professionals/k/kirk-deborah-j) to unpack the latest developments in EU and UK AI regulation and what they mean in practice. Jonathan explains that the EU's AI Omnibus is heading toward finalization before its August 2026 deadline, with key changes to high-risk AI timelines, SME exemptions and AI literacy obligations. The panel then turns to the UK's Data Use and Access Act, with Jonathan detailing how it overhauls automated decision-making, Alistair discussing the introduction of recognized legitimate interests and new criminal offenses targeting non-consensual deepfakes, and all three examining the government's decision to step back from a broad text and data mining exception. Drawing on insights from Skadden's recent AI forum, the discussion underscores one consistent message: Businesses operating across borders should plan for regulatory fragmentation, not convergence. BYTES: 5G — Beyond Faster Phones
The jump from 4G to 5G isn't incremental. And it’s no small thing. “It’s a huge leap in three key areas: speed, responsiveness and capability," says Emily Griffin (https://www.skadden.com/professionals/g/griffin-emily-l), a member of Skadden’s IP and Technology team in London. In this episode of Skadden (https://www.skadden.com/)’s “Bytes,” Emilly breaks down what 5G is and why it matters. As she explains, 5G delivers data rates up to 100 times faster than 4G, reduces latency to as little as one millisecond, and supports up to a million devices per square kilometer. Emily also highlights the legal complexities that businesses face in deploying private 5G networks, including issues of licensing, spectrum access, data control and compliance with privacy laws like the GDPR. 2026 Trends to Watch: Regulation, Infrastructure and IP in Motion
Last year was a defining year for technology regulation in the EU, with its Data Act, Apply AI Strategy, and digital omnibus proposal that signaled a shift toward a more coherent regulatory framework. What does all this mean for 2026? Tune in for a breakdown of the top six trends in technology regulation from host Deborah Kirk (https://www.skadden.com/professionals/k/kirk-deborah-j) and colleagues Jonathan Stephenson (https://www.skadden.com/professionals/s/stephenson-jonathan) and Alistair Ho (https://www.skadden.com/professionals/h/ho-alistair), of Skadden (https://www.skadden.com/)’s IP and tech transactions team in London. “If there's one unifying message here, it's that 2026 is not about invention – it’s about integration,” Deborah observes “The clients we see moving fastest are the ones embedding legal thinking into how their products are built, how contracts are structured, and how systems are governed.” Connect and Learn More ☑️ Alistair Ho (https://www.skadden.com/professionals/h/ho-alistair) | LinkedIn (https://www.linkedin.com/in/alistair-ho/) ☑️ Jonathan Stephenson (https://www.skadden.com/professionals/s/stephenson-jonathan) | LinkedIn (https://www.linkedin.com/in/jonathan-stephenson-9a671076/) ☑️ Deborah Kirk (https://www.skadden.com/professionals/k/kirk-deborah-j) | LinkedIn (https://www.linkedin.com/in/jonathan-benson-24927328/) ☑️ Skadden (https://www.skadden.com/) | LinkedIn (https://www.linkedin.com/company/skadden-arps-slate-meagher-flom-llp-affiliates/?s=footer) | X (https://x.com/skaddenarps?s=footer) | Facebook (https://www.facebook.com/skadden/?s=footer) ☑️ Subscribe Apple Podcasts (https://podcasts.apple.com/us/podcast/skadbytes/id1823233414) | Spotify (https://open.spotify.com/show/5IcW9nAsPmsLTRFUqvHmWX?si=cc3bc0ac3bfa4cfb) | Amazon Music (https://music.amazon.com/podcasts/e91fd014-dfda-4468-9262-ae1378075e09/skadbytes) “SkadBytes” is presented by Skadden, Arps, Slate, Meagher & Flom LLP and Affiliates (https://www.skadden.com/). BYTES: Agentic AI Versus Generative AI
In this "Byte," Akvile Jaseviciute (https://www.skadden.com/professionals/j/jaseviciute-akvile) from Skadden (https://www.skadden.com/)’s IP and Technology team breaks down two key AI terms: generative AI and agentic AI. Generative AI models like ChatGPT, Gemini and DALL-E create new content such as emails, images and summaries. Agentic AI, on the other hand, refers to emerging systems that are designed to plan, make decisions and carry out actions with limited human input. As AI systems start to make decisions and operate independently, businesses face tough questions about ownership, liability, bias, data protection and IP. The EU Data Act: How New Rules Could Reshape Access, Control and Competition in the Data Economy
The EU Data Act represents a fundamental change in how data will be shared, controlled and accessed across industries. Yet “you might not have heard much about this Act in the headlines,” says host Deborah Kirk (https://www.skadden.com/professionals/k/kirk-deborah-j). BYTES: Multimodal Versus Unimodal AI
In the second episode of “Bytes,” Skadden (https://www.skadden.com/)’s newest podcast, Akvile Jaseviciute (https://www.skadden.com/professionals/j/jaseviciute-akvile) breaks down the difference between unimodal and multimodal AI systems and why understanding this distinction is foundational to managing legal risk. As she explains, unimodal AI processes one type of data, like text or images. Multimodal AI, on the other hand, combines multiple data types, introducing complex licensing, data provenance, and IP infringement risks. Akvile also describes how the EU AI Act treats these systems differently: Multimodal models are more likely to be classified as general-purpose AI, which “can mean extra transparency documentation and copyright safeguards.” Connect and Learn More ☑️ Akvile Jaseviciute (https://www.skadden.com/professionals/j/jaseviciute-akvile) | LinkedIn (https://www.linkedin.com/in/akvile-jaseviciute-a5651a142/) ☑️ Deborah Kirk (https://www.skadden.com/professionals/k/kirk-deborah-j) | LinkedIn (https://www.linkedin.com/in/jonathan-benson-24927328/) ☑️ Skadden (https://www.skadden.com/) | LinkedIn (https://www.linkedin.com/company/skadden-arps-slate-meagher-flom-llp-affiliates/?s=footer) | X (https://x.com/skaddenarps?s=footer) | Facebook (https://www.facebook.com/skadden/?s=footer) ☑️ Subscribe Apple Podcasts (https://podcasts.apple.com/us/podcast/skadbytes/id1823233414) | Spotify (https://open.spotify.com/show/5IcW9nAsPmsLTRFUqvHmWX?si=cc3bc0ac3bfa4cfb) | Amazon Music (https://music.amazon.com/podcasts/e91fd014-dfda-4468-9262-ae1378075e09/skadbytes) “SkadBytes” is presented by Skadden, Arps, Slate, Meagher & Flom LLP and Affiliates (https://www.skadden.com/). BYTES: Open Source Software
Skadden (https://www.skadden.com/)’s IP and Technology team in London kicks off its series of bite-sized insights about key issues shaping the tech landscape. In the first episode of “Bytes,” Emily Griffin (https://www.skadden.com/professionals/g/griffin-emily-l) demystifies open source software (OSS) and copyleft licensing—a topic that frequently catches companies unprepared. While OSS forms the backbone of modern tech stacks and powers everything from infrastructure to AI models, many licenses come with conditions that can create unexpected legal obligations. Emily explains the crucial distinction between permissive licenses like MIT and Apache, which impose minimal requirements, and copyleft licenses like GPL, which impose stronger obligations. Tune in to learn the three essential steps that can protect you from breaching license terms. Whose Work Is It Anyway?: How UK Law Is Grappling With Generative AI and Training Data
The Getty Images v. Stability AI case represents a pivotal moment at the intersection of intellectual property and generative AI. To unpack this landmark litigation, partner Deborah Kirk (https://www.skadden.com/professionals/k/kirk-deborah-j) talks with Alistair Ho (https://www.skadden.com/professionals/h/ho-alistair) and Jonathan Stephenson (https://www.skadden.com/professionals/s/stephenson-jonathan), her London-based colleagues on Skadden (https://www.skadden.com/)'s IP and Technology team. The trio lays out Getty's allegations against Stability AI, including claims that Stability AI used millions of Getty's copyrighted images without authorization to train its AI, and allowed users to create similar images — sometimes even replicating Getty's watermark. They note that Getty has shifted its legal strategy from broad copyright claims to more targeted trademark and secondary infringement arguments. Beyond the immediate legal dispute, the case brings into focus the evolving relationship between creators and tech companies. It also raises important questions about the adequacy of existing institutional frameworks to address the challenges posed by AI and intellectual property. The discussion highlights the broader implications: a win for Stability AI could make it easier for companies to use publicly available data for AI training, while a win for Getty could set stricter standards for licensing and due diligence in the industry.
