The Supreme Judicial Court and other state and federal courts have frequently and consistently stated that such inquiry is required where there is a credible report of juror misconduct, regardless of whether or not the juror was untimely, ultimately discharged. Respectfully, further inquiry was certainly required, whereas here the inevitable result of the failure to do so was a mistrial declared over the defendant's objection, carrying all the risks of unfairness and abuse Repeatedly emphasized by both the Supreme Judicial Court and the United States Supreme Court.
