[…] It really took me a few times to go through their motion, research, talk to legal analysts about this, because at face value, it's confusing. Because as we all know about double jeopardy, it just means that a person cannot be tried for the same crime twice. But that usually involves either an acquittal or a conviction. In this case, there wasn't either. The outcome of the case was a mistrial. So ordinarily, the prosecutors could drop these charges or retry it, and it wouldn't be double jeopardy. But in this case, they're pointing to the holdout juror, they being the defense. And they're saying, alleging that Judge Sullivan did not do enough in terms of this holdout juror because there was the entire fiasco during deliberations that he allegedly was not following the law as it pertained to reasonable doubt.
