Ep. 7: Why Your Lawyer is Asking More Questions – The New AML/CTF Rules Explained

Hello mga Kabayan.  Ces here and welcome to Episode 7 of Your Legal Kabayan Podcast. Let me start with a question. Have you ever gone to your lawyer thinking, “I just need help with a contract, conveyancing or drafting my will” and suddenly, your lawyer is asking for your passport, proof of address, details about your job and even where your money came from? And you’re thinking: “Since when does my lawyer need all these?” If that feels familiar, you’re definitely not alone. Today’s episode is all about why lawyers are now legally required to ask more questions, especially if you are: buying or selling property, or doing estate planning involving trusts, companies, or asset transfers. The reason?  The new Anti-Money Laundering and Counter-Terrorism Financing rules, or AML/CTF. Let’s break down what’s changing and what this means for you as a client. -Why lawyers are now asking more questions -Why Conveyancing is most affected -What about estate planning? Here are Key Takeaways for Conveyancing Clients Expect ID checks early Be ready to explain where funds come from; and Respond quickly to document requests And for Estate Planning Clients: Simple plans may not change much Complex structures may entail more questions Being upfront usually makes everything faster and smoother Stay connected with us:Facebook: https://www.facebook.com/YourLegalKabayan (https://www.facebook.com/YourLegalKabayan)Email: ravanalawyers@gmail.comClick here (https://calendly.com/ravana_lawyers/15?month=2026-01) to book a free discovery call.

Ep. 6: No Will, No Say! What Really Happens When You Die Without One in Australia

Hello mga Kabayan.  Ces here and welcome to Episode 6 of Your Legal Kabayan Podcast.  In our last episode, we talked about the difference between a Standard Will and a Testamentary Trust Will. Today, we’re tackling a topic many people avoid – but one that affects everyone: What happens if you die without a will in Australia? A lot of people assume things like: •“My family will just sort it out.” •“Everything will automatically go to my spouse.” •“The government won’t really get involved.” Unfortunately, none of those assumptions are guaranteed. Dying without a will, what the law calls dying intestate can lead to delays, unexpected outcomes, higher costs, and even family disputes, all at a time when your loved ones are already grieving. So today, we’re going to break this down in simple terms: •What “dying intestate” really means •Who controls your estate •Who actually gets your assets •And why having a will matters even more for modern and migrant families Final ThoughtsBefore we wrap up, I want to leave you with a few final thoughts.A will is not about planning for death. It’s about protecting the people you love. When you don’t have a will, the government decides for you.  The process takes longer.  The costs are higher.  And the outcome may look nothing like what you wanted. But when you do have a will, you stay in control.  You give your family clarity.  And you give them something priceless - peace of mind. If your life has changed through marriage, children, separation, or buying property and you haven’t reviewed or prepared a will – now is the moment to make sure your loved ones are protected. Ep. 5: Standard Will vs Testamentary Trust Will – What’s the Difference?

Hello mga kabayan! Ces here, and welcome to Episode #5 of Your Legal Kabayan Podcast. Today, we’re talking about wills — this is basically the instruction manual you leave behind for your loved ones. And we’ll dive into a question many families ask: What’s the difference between a Standard Will and a Testamentary Trust Will? By the end of this episode, you’ll understand how they differ, and which one might be the better fit for your family. Episode Highlights: •What is a Standard Will? •Now Let’s Talk About a Testamentary Trust Will. What Is It? •Distribution of Assets •Protection •Tax Benefits •Flexibility So here’s the takeaway: estate planning isn’t only about who gets what. It’s about safeguarding your family’s future and ensuring your wishes are carried out exactly the way you hoped for. Think of it this way: a standard will hands everything over quickly and cleanly. A testamentary trust will guides your family long after you’re gone — protecting them, supporting them, and managing the inheritance in a way that truly reflects your intentions. If you’re unsure which option is right for you, it’s always best to get personalised legal advice. Ep. 4: Navigating Immigration in Australia

Hello mga kabayan.  Ces here and welcome to episode #4 of Your Legal Kabayan Podcast. Today, we’re diving into a topic that every Filipino migrant should know —whether you're already here in Australia or still planning your journey:  immigration pathways. If you’ve ever felt confused by visas, unsure which path to take, or worried about making the wrong move, this episode is for you. Why Australia? Australia is so much more than stunning beaches, kangaroos, and those iconic Sydney Opera House selfies we all adore. It’s a nation celebrated for: A resilient, thriving economy World-class education that opens global doors Exceptional safety and a standard of living that people around the world look up to And a vibrant multicultural community where Filipinos continue to grow, succeed, and feel at home. Every year, thousands of migrants choose Australia for a brighter future for themselves and their families. But here’s something I always remind people: Immigration isn’t one straight line. It’s a set of pathways. And choosing the wrong pathway—kahit hindi sinasadya—can cost you time, money, and opportunities. Two Big Categories of Australian Visas To make this really simple, imagine that Australian visas fall into two big buckets: Temporary Visas Permanent visas or what we call PR Now, let’s talk about the most common visa pathways that Filipinos always ask about. Student Visas Temporary Work Visas Skilled Migration Visas Partner and Family Visas Now let’s talk about the most common mistakes I see over and over again when it comes to visas and migration planning: 1. Relying on hearsay from friends, relatives, or Facebook posts. 2. Having a “one-visa-at-a-time” mindset. 3. Asking for help only when there’s already a problem. If you’re unsure about your pathway, start by asking yourself: Do I want to stay temporarily, or is PR really my goal? What skills or qualifications do I have right now? Am I following a real, structured plan — or just hoping things will work out? Immigration isn’t just about filling out forms – it’s life planning. Every decision you make affects your future, your finances, and your stability. Migrating to Australia is not simply a checklist of requirements.  It’s a life-changing journey — emotionally, financially, and legally. And yes, it can be overwhelming. Visa rules shift, documents pile up, and delays or requests for more information can really test your patience. But here’s the good news, you don’t have to do this alone. If you want to avoid unnecessary stress and costly mistakes, here are a few steps that truly make a difference: Seek professional advice. Prepare early. Stay informed. Connect with your community. Migrating to Australia is a big step — but it’s a step you can take with confidence. With the right information, a clear strategy, and proper guidance, the process becomes clearer, smoother, and far more manageable. And remember: the dream is possible. Your pathway may look different from someone else’s, but it’s yours and you have every right to build a future you and your family can be proud of.
