About Bound By Oath by IJ

Bound by Oath is a podcast series from the Center for Judicial Engagement at the Institute for Justice. It’s where the Constitution’s past catches up with the present. Article VI of the U.S. Constitution requires every judge to be “bound by Oath” to uphold “this Constitution.” But to understand if judges are following that oath, it’s important to ask, “What is in ‘this Constitution’?” Your host John Ross takes a deep dive into the Constitution’s text, history, and characters, and interviews historians, legal scholars, and the real people involved in historic and contemporary cases.

One starting point that one could use to think about this is the 14th Amendment, because that's when you see much more in the way of state and local prosecutions, where people are going to federal court to enjoin them. You don't have nearly as much of that before the 14th Amendment, for obvious reasons. So what are the circumstances when you could go to federal court to enjoin a state prosecution? Professor Smith has collected the cases, and he says that traditionally, plaintiffs needed to make a showing that if the federal court did not intervene, they would suffer great, immediate, and irreparable harm.
