[…] The government, in this case, is arguing that there is an exception to Article III, and that is an exception for immigration. And they're partially right but mostly wrong in this case. There is a long history of the court saying Article III doesn't apply to immigration matters as regards to coming into the country or staying in the country or even being removed from the country. If you are a foreign national and you come to the country, that is according to the court and for a very long time. That's a benefit. It's not a right. And essentially, the executive branch has the ability to decide benefits, not rights. […]
