Fame Under Fire is at Southwark Crown Court for the trial of comedian, actor and broadcaster Russell Brand. Brand faces seven sexual offence charges involving six women: three counts of rape, three counts of sexual assault and one count of indecent assault. The alleged offences date from 1999 to 2009. He has pleaded not guilty to all the charges. Under UK court reporting rules, cameras and recording device are not allowed inside the courtroom. […] And so what we have now is the prosecution must prove that the complainant did not consent and that the defendant did not reasonably believe that the complainant consented. And when it comes to the reasonableness that is judged in the circumstances of a case. And so we we take each case on a case by case basis. Every case is different. and it's left to the jury to decide what is reasonable in any given circumstances. The key thing about the old law, it was your actual and honest belief, whereas the new law is looking for a reasonable belief. And so under the old law, you could potentially have a ridiculous belief, a drunken belief, an unreasonable belief even, whereas under the new law, it's much more prosecution. centric and much more favourable to the prosecution.
