Legal Vortex: Mandatory Reporting to the BoEE — What School Administrators Need to Know

In this Legal Vortex episode of the It's Been SAId podcast, SAI Legal Services Director Matt Carver breaks down the essential reporting requirements for school administrators submitting mandatory reports regarding practitioner misconduct to the Board of Educational Examiners (BoEE). This 21-minute episode details the triggering disciplinary actions that mandate reporting—ranging from written reprimands to terminations—and explores the six key categories of misconduct. Listeners will gain clear insight into explicit definitions and practical scenarios covering student boundary violations, record falsification, public property misuse, substance impairment, direct discrimination, and student abuse. Show Notes Host: Matt Carver Podcast: SAI's Legal Vortex Overview School administrators often face complex decisions regarding when and how to report practitioner misconduct to the Board of Educational Examiners (BoEE). In this episode, Matt Carver walks through the triggering events that require formal reporting and provides a comprehensive breakdown of the six misconduct categories. Key Discussion Points Triggering Disciplinary Actions Mandatory BoEE reporting is triggered by formal disciplinary actions taken against a practitioner, including written reprimands, written warnings, separation agreements, resignations, non-renewals, or terminations. Administrators must not withhold or avoid necessary disciplinary actions simply because doing so triggers a mandatory report to the BoEE. Primary reporting responsibility falls on superintendents or Area Education Agency (AEA) chief administrative officers, though failure to report can lead to disciplinary action against other administrators who fail to escalate information. The Six Categories of Reportable Misconduct Inappropriate Student Relationships & Grooming: Encompasses physical or sexual interactions, expanded definitions of grooming (actions intended to entice or entrap a student for personal gain), and inappropriate communications, such as late-night direct messaging using informal, student-like language. Falsifying Official Records: Includes altering grades or test scores, as well as fabricating progress-monitoring data (common in special education settings) when data collection falls behind. Conversion of Public Property or Funds: Covers unauthorized personal use of district resources, including vehicles, snowplows, laptops for side businesses, or school facilities for private paid lessons without approval or rental agreements. Substance Impairment: Being on school grounds or at student-sponsored events while possessing, using, or impaired by illegal drugs or alcohol. While an off-duty drink may not automatically constitute legal impairment, observable signs like slurred speech or staggering trigger reporting requirements. Discrimination Based on Free Speech or Intellectual Freedom: Penalizing students (such as lowering grades or taking retaliatory action) simply because their expressed political, social, or personal viewpoints differ from the practitioner's. Abuse of a Student: Instances of student abuse or assault, which require both a report to the BOEE and parallel reports to Health and Human Services (HHS) and local law enforcement. Legal Best Practices When facing uncertainty regarding mandatory reporting requirements, administrators should consult district legal counsel or organizational legal staff. Documenting reliance on professional legal advice provides strong protection against potential ethical claims or BoEE actions.
