Nuovi obblighi della normativa "Whistleblowing"
L’Italia, con il recente D.Lgs. 24/2023, ha recepito la direttiva (UE) 2019/1937 del Parlamento europeo e del Consiglio (ottobre 2019), riguardante la protezione delle persone che segnalano violazioni del diritto dell'Unione e delle normative nazionali. Il D.Lgs. 24/2023 ha modificato la normativa previgente, disciplinando con un unico provvedimento, valido sia per il per il settore pubblico che per il settore privato, il regime di protezione dei soggetti che segnalano condotte illecite in violazione di disposizioni europee e nazionali. Nuovo processo tributario: contenuti e prospettive della recente riforma
In attuazione degli obiettivi del PNRR, dopo anni di attesa è stata approvata la nuova, strutturale riforma della giustizia tributaria al fine di migliorarne l’efficienza complessiva, la qualità delle pronunce e la riduzione del contenzioso. Il Parlamento, su iniziativa governativa, ha recentemente varato la Legge n. 130/2022 che modifica in modo significativo le regole processuali del contenzioso tributario e l’organizzazione del corpo giudicante, i cui membri saranno ora selezionati tramite concorso per esami. Tra le novità più importanti si segnalano l’introduzione della prova testimoniale e nuovi strumenti di deflazione del contenzioso come il potenziamento della conciliazione e la definizione agevolata delle liti pendenti in Cassazione – oltre all’introduzione del giudice monocratico per le controversie di modico valore.
