2년여 간을 함께 했던 박하정 기자가 최종의견을 떠나게 됐습니다. 그동안 최종의견에서 어떤 점을 느꼈는지, 청취자 여러분들께 하고 싶은 말은 무엇인지, 그 동안의 이야기를 담았습니다. 지난 6일, 국회에서는 이균용 대법원장 후보자에 대한 임명동의안이 부결됐습니다. 출석 의원 295명 중 찬성 118명, 반대 175명, 기권 2명의 결과가 나온 겁니다. 민주당과 정의당이 ‘부결’을 당론으로 정하면서 야권에서 반대표가 대거 나온 결과로 풀이됩니다. 대법원장 임명동의안이 국회에서 부결된 건 35년 만이고, 공석 사태는 30년 만이라고 하는데 이로 인해 생기는 문제는 없는지, 향후 전망은 어떤지도 얘기 나눠 봅니다. 40년 만에 강제추행 판례가 바뀌었다?
대법원 전원합의체가 강제추행 죄와 관련해 40년 만에 다른 판단을 내놨습니다. 그동안 범행에 동반되는 폭행이나 협박이 피해자가 저항하기 곤란할 정도인지를 따졌는데, 이를 다소 완화한 겁니다. 어떤 취지에서 이렇게 판례 변경이 이뤄졌는지 살펴봅니다. 또 추석 연휴 직전인 지난 27일 새벽, 이재명 민주당 대표에 대한 구속영장이 기각됐습니다. 검찰이 이른바 백현동 사건, 대북송금 사건, 위증교사 의혹 등 여러 가지 혐의를 한데 모아 청구한 구속영장이었죠. 체포 동의안이 국회에서 가결되면서 이 대표는 9시간 넘는 구속 전 피의자 심문을 받았습니다. 지난 2월 청구됐던 첫 번째 구속영장은 체포 동의안이 부결되면서 그 효력이 없었죠. 이번 구속영장 청구 이후엔 심사 단계까지 간 건데, 결과는 기각이었습니다. 정치적으로도 많은 후폭풍이 일고 있는데, 이재명 대표 구속영장 청구의 굵직한 혐의와 기각 사유가 무엇인지, 기각 사유가 일부 서로 모순된다는 설명은 무엇인지 이야기 나눠 보겠습니다. * sbsvoicenews@gmail.com으로 사연 많이 보내주세요. 법률 상담해 드립니다.
