驾驶人在驾驶证暂扣期间属于未取得驾驶资格
<p style="color:#333333;font-weight:normal;font-size:16px;line-height:30px;font-family:Helvetica,Arial,sans-serif;hyphens:auto;text-align:justify;" data-flag="normal"><span>交通管理部门为驾驶人核发的驾驶证是对驾驶人驾驶机动车的行政许可。</span><span>交通管理部门依法暂扣驾驶人的驾驶证，是暂时中止这种行政许可。</span><span>驾驶人在驾驶证被暂扣期间没有驾驶资格，其是否取得过驾驶证或能否重新取得驾驶证均不影响其已经暂时丧失驾驶资格的事实。</span><span>只有当驾驶证被依法返还驾驶人之后，对其驾驶资格的行政许可才能恢复。</span><span>因此，驾驶人在驾驶证被暂扣期间驾驶车辆属于“未取得驾驶资格或未取得相应驾驶资格”的情形。驾驶人在驾驶证暂扣期间驾驶机动车，发生交通事故造成第三人人身损害，保险公司在交强险责任限额内向受害人赔偿后，对驾驶人享有追偿权。</span><br></p>

河南省交通肇事罪附带民事诉讼赔偿范围
<p style="color:#333333;font-weight:normal;font-size:16px;line-height:30px;font-family:Helvetica,Arial,sans-serif;hyphens:auto;text-align:justify;" data-flag="normal">河南中锦律师事务所刘伟律师结合刑事诉讼法及相关司法解释及河南省相关裁判文书，总结河南省交通肇事罪附带民事诉讼赔偿范围，供办案参考。刑事附带民事诉讼相比单独提起民事诉讼，优点在于快，刑事附带民事诉讼不向原告人收取诉讼费。缺点在于，部分法院不支持精神抚慰金。<br></p>

<p style="color:#333333;font-weight:normal;font-size:16px;line-height:30px;font-family:Helvetica,Arial,sans-serif;hyphens:auto;text-align:justify;" data-flag="normal">河南中锦律师事务所刘伟律师根据河南高院印发《关于常见犯罪的量刑指导意见（试行）》实施细则（试行）豫高法〔2024〕158号文件，总结河南法院关于适用缓刑条件，当事人及辩护人可以按照适用缓刑条件，为被告人争取缓刑。被告人被宣告缓刑，根据《刑法》第七十六条，在缓刑考验期限内，依法实行社区矫正，如果没有本法第七十七条规定的情形，缓刑考验期满，原判的刑罚就不再执行。换句话说，被法院判处的缓刑的犯罪分子在缓刑考验期内，可以不用去监狱服刑。<br></p>
